57 relating to reimbursement of federal military treatment facilities
68 under the workers' compensation system.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter B, Chapter 413, Labor Code, is
911 amended by adding Section 413.0112 to read as follows:
1012 Sec. 413.0112. REIMBURSEMENT OF FEDERAL MILITARY TREATMENT
1113 FACILITY. (a) In this section, "federal military treatment
1214 facility" means a medical facility that operates as part of the
1315 Military Health System of the United States Department of Defense.
1416 (b) The reimbursement rates for medical services provided
1517 to an injured employee by a federal military treatment facility
1618 must be the amount charged by the facility as determined under 32
1719 C.F.R. Part 220.
1820 (c) Chapter 1305, Insurance Code, and the following
1921 sections of this code do not apply to the reimbursement of a federal
2022 military treatment facility's charges for medical services
2123 provided to an injured employee:
2224 (1) Sections 408.027(a) and (f);
2325 (2) Section 408.0271;
2426 (3) Section 408.0272;
2527 (4) Section 408.028;
2628 (5) Section 408.0281;
2729 (6) Section 413.011;
2830 (7) Section 413.014;
2931 (8) Section 413.031, as that section relates to
3032 medical fee disputes;
3133 (9) Section 413.041; and
3234 (10) Section 504.053.
3335 (d) The commissioner shall adopt rules necessary to
3436 implement this section, including rules establishing:
3537 (1) requirements for processing medical bills for
3638 services provided to an injured employee by a federal military
3739 treatment facility; and
3840 (2) a separate medical dispute resolution process to
3941 resolve disputes over charges billed directly to an injured
4042 employee by a federal military treatment facility.
4143 SECTION 2. The commissioner of workers' compensation shall
4244 adopt rules as required by Section 413.0112, Labor Code, as added by
4345 this Act, not later than December 1, 2019.
4446 SECTION 3. The change in law made by this Act applies only
4547 to health care services provided on or after January 1, 2020, in
4648 conjunction with a claim for workers' compensation benefits,
4749 regardless of the date on which the compensable injury that is the
4850 basis of the claim occurred.
4951 SECTION 4. This Act takes effect September 1, 2019.
