117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Subtitle B, Title 7, Transportation Code, is
13- amended by adding Chapter 526 to read as follows:
14- CHAPTER 526. DIGITAL IDENTIFICATION PILOT PROGRAM
15- Sec. 526.001. DEFINITIONS. In this chapter:
8+ SECTION 1. DEFINITIONS. In this Act:
169 (1) "Department" and "driver's license" have the
17- meanings assigned by Section 521.001.
10+ meanings assigned by Section 521.001, Transportation Code.
1811 (2) "Digital identification" includes digital
1912 driver's licenses and digital personal identification
2013 certificates.
21- Sec. 526.002. DIGITAL IDENTIFICATION PILOT PROGRAM. (a)
22- The department by rule shall establish a pilot program for the
23- issuance of digital identification.
24- (b) In establishing the digital identification pilot
25- program, the department shall:
26- (1) assess existing department infrastructure and
27- identify changes required to implement the program;
28- (2) upgrade department infrastructure according to
29- the department's findings under Subdivision (1);
30- (3) acquire a mobile application that:
31- (A) displays digital identification that
32- includes the information described by Section 521.121(a) on a
33- wireless communication device;
34- (B) includes an authentication and verification
14+ SECTION 2. STUDY AND REPORT. (a) The department shall
15+ conduct a study on the feasibility of issuing digital
16+ identification in this state.
17+ (b) The study must:
18+ (1) determine whether the department should establish
19+ a pilot program for the issuance of digital identification;
20+ (2) determine whether a person may use digital
21+ identification in the same manner as a physical driver's license or
22+ personal identification certificate, including whether
23+ circumstances exist under which a person may not use digital
24+ identification;
25+ (3) assess existing department infrastructure and
26+ identify changes required to issue digital identification in this
27+ state;
28+ (4) evaluate existing mobile applications that:
29+ (A) are capable of displaying digital
30+ identification;
31+ (B) include an authentication and verification
3532 process for a wireless communication device; and
3633 (C) may be used in any location regardless of the
37- location's level of wireless connectivity or cellular telephone
38- service;
39- (4) deploy the digital identification mobile
40- application at no cost to focus groups for testing and evaluation;
41- and
42- (5) implement a law enforcement version of the
43- application for field testing.
44- (c) Digital identification issued under this section may
45- not be used or accepted as valid proof of identification.
46- (d) The department may contract with a third party to
47- establish the pilot program described by this section if the
48- contract is at no cost to the department.
49- (e) The department shall prepare a report containing the
50- results of the pilot program and the department's recommendations.
51- The department shall submit the report to the Public Safety
52- Commission and the legislature not later than the 180th day after
53- the date of completion of the pilot program.
54- Sec. 526.003. EXPIRATION. This chapter expires September
55- 1, 2021.
56- SECTION 2. The Department of Public Safety shall adopt the
57- initial rules for the digital identification pilot program under
58- Chapter 526, Transportation Code, as added by this Act, not later
59- than February 1, 2020.
60- SECTION 3. This Act takes effect immediately if it receives
61- a vote of two-thirds of all the members elected to each house, as
62- provided by Section 39, Article III, Texas Constitution. If this
63- Act does not receive the vote necessary for immediate effect, this
64- Act takes effect September 1, 2019.

35+ (5) examine methods other digital identification
36+ programs use to maintain the security of the program, including:
37+ (A) how other digital identification programs
38+ ensure that the information provided by the digital identification
39+ is accessible only for that purpose; and
40+ (B) the security features other digital
41+ identification programs use to protect against identity theft.
42+ (c) Not later than December 1, 2022, the department shall
43+ submit to the governor, lieutenant governor, and members of the
44+ legislature a report that includes the findings of the study
45+ conducted under this section and any legislative recommendations
46+ based on the study.
47+ SECTION 3. CONFIDENTIALITY. Personal identifying
48+ information, as defined by Section 521.002, Business & Commerce
49+ Code, collected or maintained for the study conducted by the
50+ department under Section 2 of this Act is confidential and not
51+ subject to disclosure under Chapter 552, Government Code.
52+ SECTION 4. EXPIRATION DATE. This Act expires January 1,
53+ 2023.
54+ SECTION 5. EFFECTIVE DATE. This Act takes effect
55+ immediately if it receives a vote of two-thirds of all the members
56+ elected to each house, as provided by Section 39, Article III, Texas
57+ Constitution. If this Act does not receive the vote necessary for
58+ immediate effect, this Act takes effect September 1, 2019.
