5	7		relating to a state plan for education on and treatment of
6	8		Alzheimer's disease and related disorders.
7	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	10		SECTION 1. Subtitle D, Title 2, Health and Safety Code, is
9	11		amended by adding Chapter 99 to read as follows:
10	12		CHAPTER 99. STATE PLAN FOR ALZHEIMER'S DISEASE AND RELATED
11	13		DISORDERS
12	14		Sec. 99.001. DEVELOPMENT AND IMPLEMENTATION OF STATE PLAN.
13	15		(a) The department, using existing resources and programs to the
14	16		extent possible, shall develop and implement a state plan for
15	17		education on and treatment of Alzheimer's disease and related
16	18		disorders.
17	19		(b) The state plan must include strategies for:
18	20		(1) improving early detection of, reducing disease
19	21		onset risks for, and improving treatment of Alzheimer's disease and
20	22		related disorders for specific demographic groups;
21	23		(2) educating health care professionals, caregivers,
22	24		and the public to increase awareness of Alzheimer's disease and
23	25		related disorders;
24	26		(3) providing caregiver support;
25	27		(4) advancing basic science and applied research
26	28		related to Alzheimer's disease and related disorders; and
27	29		(5) collecting and evaluating information on efforts
28	30		to prevent and treat Alzheimer's disease and related disorders.
29	31		(c) The department shall develop the strategies described
30	32		by Subsection (b)(1) in consultation with physicians and other
31	33		health care providers licensed in this state who have clinical
32	34		training and experience in caring for persons with Alzheimer's
33	35		disease or related disorders.
34	36		Sec. 99.002. COMMENTS FROM INTERESTED PARTIES. (a) In
35	37		developing the state plan under Section 99.001, the department
36	38		shall seek comments from interested parties, including:
37	39		(1) members of the public with, or who care for persons
38	40		with, Alzheimer's disease or related disorders;
39	41		(2) each state agency that provides services to
40	42		persons with Alzheimer's disease or related disorders;
41	43		(3) any advisory body that addresses issues related to
42	44		Alzheimer's disease or related disorders;
43	45		(4) public advocates concerned with issues related to
44	46		Alzheimer's disease or related disorders;
45	47		(5) physicians and health care providers licensed in
46	48		this state who have clinical training and experience in caring for
47	49		persons with Alzheimer's disease or related disorders; and
48	50		(6) researchers of issues affecting persons with
49	51		Alzheimer's disease or related disorders.
50	52		(b) On request of the department, the commission shall
51	53		provide information and comments related to services provided to
52	54		persons with Alzheimer's disease or related disorders.
53	55		(c) The department shall meet with interested parties at
54	56		least two times each year to:
55	57		(1) facilitate comments on and discuss the progress of
56	58		developing and implementing the state plan developed under this
57	59		chapter; and
58	60		(2) gather information for the report required under
59	61		Section 99.004.
60	62		Sec. 99.003. REVIEW AND MODIFICATION OF STATE PLAN. The
61	63		department shall conduct a review and modify as necessary the state
62	64		plan developed under this chapter at least once every five years.
63	65		Sec. 99.004. REPORT. Not later than September 1 of each
64	66		even-numbered year, the department shall submit to the legislature
65	67		a report on the development and implementation or the review or
66	68		modification of the state plan developed under this chapter.
67	69		Sec. 99.005. GIFTS AND GRANTS. The department may accept
68	70		gifts and grants from any source to fund the duties of the
69	71		department under this chapter.
70	72		Sec. 99.006. NO CAUSE OF ACTION, DUTY, STANDARD OF CARE, OR
71	73		LIABILITY CREATED. Notwithstanding any other law, Section 99.001,
72	74		including the use of or failure to use any information or materials
73	75		developed or disseminated under that section, does not create a
74	76		civil, criminal, or administrative cause of action or liability or
75	77		create a standard of care, obligation, or duty that provides a basis
76	78		for a cause of action.
77	79		SECTION 2. This Act takes effect September 1, 2019.
