66 AN ACT
77 relating to the use of promotoras and community health workers in
88 Medicaid managed care.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 533, Government Code, is
1111 amended by adding Section 533.021 to read as follows:
1212 Sec. 533.021. PROMOTORAS AND COMMUNITY HEALTH WORKERS. (a)
1313 In this section, "promotora" and "community health worker" have the
1414 meaning assigned by Section 48.001, Health and Safety Code.
1515 (b) The commission shall allow each Medicaid managed care
1616 organization providing health care services under the STAR Medicaid
1717 managed care program to categorize services provided by a promotora
1818 or community health worker as a quality improvement cost, as
1919 authorized by federal law, instead of as an administrative expense.
2020 SECTION 2. If before implementing any provision of this Act
2121 a state agency determines that a waiver or authorization from a
2222 federal agency is necessary for implementation of that provision,
2323 the agency affected by the provision shall request the waiver or
2424 authorization and may delay implementing that provision until the
2525 waiver or authorization is granted.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2021.
