| 11 | 8 | | relating to the authority of certain counties to authorize the |

| 12 | 9 | | operation of a golf cart or off-highway vehicle on certain roads. |

| 13 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 11 | | SECTION 1. Section 551.404(c), Transportation Code, is |
|---|
| 15 | 12 | | amended to read as follows: |
|---|
| 16 | 13 | | (c) Subsection (b) applies only to a county that: |
|---|
| 17 | 14 | | (1) borders or contains a portion of the Red River; or |
|---|
| 18 | 15 | | (2) [borders or contains a portion of the Guadalupe |
|---|
| 19 | 16 | | River and contains a part of a barrier island that] borders the Gulf |
|---|
| 20 | 17 | | of Mexico and has a population of less than 500,000[; or |
|---|
| 21 | 18 | | [(3) is adjacent to a county described by Subdivision |
|---|
| 22 | 19 | | (2) and: |
|---|
| 23 | 20 | | [(A) has a population of less than 37,000; and |
|---|
| 24 | 21 | | [(B) contains a part of a barrier island or |
|---|
| 25 | 22 | | peninsula that borders the Gulf of Mexico]. |

| 26 | 23 | | SECTION 2. Section 551A.053(c), Transportation Code, is |
|---|
| 27 | 24 | | amended to read as follows: |
|---|
| 28 | 25 | | (c) Subsection (b) applies only to a county that: |
|---|
| 29 | 26 | | (1) borders or contains a portion of the Red River; or |
|---|
| 30 | 27 | | (2) [borders or contains a portion of the Guadalupe |

| 40 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 39 | | Act takes effect September 1, 2021. |
