4	11		AN ACT
5	12		relating to the care of pregnant women in county jail or in the
6	13		custody of the Texas Department of Criminal Justice.
7	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	15		SECTION 1. Subchapter B, Chapter 501, Government Code, is
9	16		amended by adding Section 501.0668 to read as follows:
10	17		Sec. 501.0668. DUTIES FOLLOWING MISCARRIAGE OR PHYSICAL OR
11	18		SEXUAL ASSAULT OF PREGNANT INMATE. (a) In this section:
12	19		(1) "Physical assault" means any conduct that
13	20		constitutes an offense under Section 22.01 or 22.02, Penal Code.
14	21		(2) "Sexual assault" means any conduct that
15	22		constitutes an offense under Section 22.011 or 22.021, Penal Code.
16	23		(b) As soon as practicable after receiving a report of a
17	24		miscarriage or physical or sexual assault of a pregnant inmate, the
18	25		department shall ensure that an obstetrician or gynecologist and a
19	26		mental health professional promptly:
20	27		(1) review the health care services provided to the
21	28		inmate; and
22	29		(2) order additional health care services, including
23	30		obstetrical and gynecological services and mental health services,
24	31		as appropriate.
25	32		SECTION 2. Subchapter C, Chapter 351, Local Government
26	33		Code, is amended by adding Section 351.048 to read as follows:
27	34		Sec. 351.048. DUTIES FOLLOWING MISCARRIAGE OR PHYSICAL OR
28	35		SEXUAL ASSAULT OF PREGNANT PRISONER. (a) In this section:
29	36		(1) "Physical assault" means any conduct that
30	37		constitutes an offense under Section 22.01 or 22.02, Penal Code.
31	38		(2) "Sexual assault" means any conduct that
32	39		constitutes an offense under Section 22.011 or 22.021, Penal Code.
33	40		(b) As soon as practicable after receiving a report of a
34	41		miscarriage or physical or sexual assault of a pregnant prisoner
35	42		while in the custody of a county jail, the sheriff shall ensure that
36	43		an obstetrician or gynecologist and a mental health professional
37	44		promptly:
38	45		(1) review the health care services provided to the
39	46		prisoner; and
40	47		(2) order additional health care services, including
41	48		obstetrical and gynecological services and mental health services,
42	49		as appropriate.
43	50		SECTION 3. This Act takes effect September 1, 2021.
