411 AN ACT
512 relating to the care of pregnant women in county jail or in the
613 custody of the Texas Department of Criminal Justice.
714 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
815 SECTION 1. Subchapter B, Chapter 501, Government Code, is
916 amended by adding Section 501.0668 to read as follows:
1017 Sec. 501.0668. DUTIES FOLLOWING MISCARRIAGE OR PHYSICAL OR
1118 SEXUAL ASSAULT OF PREGNANT INMATE. (a) In this section:
1219 (1) "Physical assault" means any conduct that
1320 constitutes an offense under Section 22.01 or 22.02, Penal Code.
1421 (2) "Sexual assault" means any conduct that
1522 constitutes an offense under Section 22.011 or 22.021, Penal Code.
1623 (b) As soon as practicable after receiving a report of a
1724 miscarriage or physical or sexual assault of a pregnant inmate, the
1825 department shall ensure that an obstetrician or gynecologist and a
1926 mental health professional promptly:
2027 (1) review the health care services provided to the
2128 inmate; and
2229 (2) order additional health care services, including
2330 obstetrical and gynecological services and mental health services,
2431 as appropriate.
2532 SECTION 2. Subchapter C, Chapter 351, Local Government
2633 Code, is amended by adding Section 351.048 to read as follows:
2734 Sec. 351.048. DUTIES FOLLOWING MISCARRIAGE OR PHYSICAL OR
2835 SEXUAL ASSAULT OF PREGNANT PRISONER. (a) In this section:
2936 (1) "Physical assault" means any conduct that
3037 constitutes an offense under Section 22.01 or 22.02, Penal Code.
3138 (2) "Sexual assault" means any conduct that
3239 constitutes an offense under Section 22.011 or 22.021, Penal Code.
3340 (b) As soon as practicable after receiving a report of a
3441 miscarriage or physical or sexual assault of a pregnant prisoner
3542 while in the custody of a county jail, the sheriff shall ensure that
3643 an obstetrician or gynecologist and a mental health professional
3744 promptly:
3845 (1) review the health care services provided to the
3946 prisoner; and
4047 (2) order additional health care services, including
4148 obstetrical and gynecological services and mental health services,
4249 as appropriate.
4350 SECTION 3. This Act takes effect September 1, 2021.
