45 A BILL TO BE ENTITLED
56 AN ACT
67 relating to waivers for entrance fees to state parks for resident
78 first responders, military service members, and veterans.
89 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
910 SECTION 1. Section 13.015, Parks and Wildlife Code, is
10- amended by amending Subsection (a-2) and adding Subsections (a-3)
11- and (a-4) to read as follows:

1213 (a-2) The department shall waive the park entrance fee for a
1314 resident of this state who is a first responder. In this
1415 subsection, "first responder" means a person who is:
1516 (1) a firefighter certified by the Texas Commission on
1617 Fire Protection or by the State Firefighters' and Fire Marshals'
1718 Association of Texas;
1819 (2) an individual certified as emergency medical
1920 services personnel by the Department of State Health Services;
2021 (3) a municipal police officer;
2122 (4) a sheriff, deputy sheriff, or reserve deputy
2223 sheriff; or
2324 (5) a constable, deputy constable, or reserve deputy
2425 constable.
25- (a-3) The department shall waive the park entrance fee for
26- an active duty member or veteran of the armed services of the United
27- States, the Texas Army National Guard, the Texas Air National
28- Guard, or the Texas State Guard.
29- (a-4) The department may promote visits and enhance revenue

3330 SECTION 2. Section 13.018(a), Parks and Wildlife Code, is
3431 amended to read as follows:
3532 (a) The following people may apply to the department for a
3633 state parklands passport:
3734 (1) a resident of this state who is 65 years old or
3835 over who has resided in the state for six consecutive months
3936 preceding the date of application for a parklands passport[, a
4037 member of the United States armed forces on active duty who is 65
4138 years old or over,] or any other individual in a category that the
4239 commission by rule designates as a resident of this state who is 65
43- years old or over; and
44- (2) [a veteran of the armed services of the United
45- States who, as a result of military service, has a
46- service-connected disability, as defined by the Veterans'
47- Administration, consisting of the loss of the use of a lower
48- extremity or of a 60 percent disability rating and who is receiving
49- compensation from the United States because of the disability; and
50- [(3)] an individual who has a physical or mental
40+ years old or over;
41+ (2) an active duty member or [a] veteran of the armed
42+ services of the United States, the Texas Army National Guard, the
43+ Texas Air National Guard, or the Texas State Guard [who, as a result
44+ of military service, has a service-connected disability, as defined
45+ by the Veterans' Administration, consisting of the loss of the use
46+ of a lower extremity or of a 60 percent disability rating and who is
47+ receiving compensation from the United States because of the
48+ disability]; and
49+ (3) an individual who has a physical or mental
5150 impairment that substantially limits one or more of the major life
5251 activities of the individual.
5352 SECTION 3. This Act takes effect September 1, 2021.
