| 14 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 11 | | SECTION 1. Subchapter A, Chapter 1579, Insurance Code, is |
|---|
| 16 | 12 | | amended by adding Section 1579.010 to read as follows: |
|---|
| 17 | 13 | | Sec. 1579.010. PARTICIPATING ENTITY REQUEST FOR CERTAIN |
|---|
| 18 | 14 | | INFORMATION. (a) Subject to Subsection (b), the trustee shall |
|---|
| 19 | 15 | | provide to a participating entity any de-identified health |
|---|
| 20 | 16 | | information, enrollment information, or other relevant information |
|---|
| 21 | 17 | | available to the trustee as requested by the entity in connection |
|---|
| 22 | 18 | | with a search for alternative health benefit plan coverage for the |
|---|
| 23 | 19 | | entity's employees and the employees' dependents. |
|---|
| 24 | 20 | | (b) The information provided by the trustee under this |
|---|
| 25 | 21 | | section may not include any personally identifying information of a |
|---|
| 26 | 22 | | covered individual that would be prohibited from disclosure under |
|---|
| 27 | 23 | | the Health Insurance Portability and Accountability Act of 1996 |
|---|
| 28 | 24 | | (Pub. L. No. 104-191) and regulations adopted under that Act. |
|---|
| 29 | 25 | | (c) The trustee shall provide the information requested |
|---|
| 30 | 26 | | under this section at no cost to the requesting participating |
|---|
| 31 | 27 | | entity, in accordance with the procedures developed by the trustee |
|---|
| 32 | 28 | | for that purpose. |
|---|
| 33 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 33 | | Act takes effect September 1, 2021. |
