77 relating to regulation of health care cost-sharing organizations.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Subtitle K, Title 8, Insurance
1010 Code, is amended to read as follows:
1111 SUBTITLE K. HEALTH CARE COST SHARING [MINISTRIES]
1212 SECTION 2. Subtitle K, Title 8, Insurance Code, is amended
1313 by adding Chapter 1682 to read as follows:
1414 CHAPTER 1682. HEALTH CARE COST-SHARING ORGANIZATIONS
1515 SUBCHAPTER A. GENERAL PROVISIONS
1616 Sec. 1682.0001. DEFINITIONS. In this chapter:
1717 (1) "Health care cost-sharing organization" means an
1818 entity that facilitates the sharing of health care expenses among
1919 the entity's participants. The term does not include a health
2020 benefit plan issuer or a health care sharing ministry described by
2121 Section 1681.001.
2222 (2) "Participant" means an individual enrolled in a
2323 health care cost-sharing organization to voluntarily share health
2424 care expenses with other individuals enrolled in the organization.
2525 Sec. 1682.0002. EXEMPTION. Notwithstanding any other
2626 provision of this code, a health care cost-sharing organization
2727 that acts in accordance with this chapter is not considered to be
2828 engaging in the business of insurance.
2929 Sec. 1682.0003. CONSTRUCTION OF CHAPTER. This chapter may
3030 not be construed to assign responsibility for a person's health
3131 care expenses to any other person.
3232 SUBCHAPTER B. REGULATION OF HEALTH CARE COST-SHARING ORGANIZATIONS
3333 Sec. 1682.0051. HEALTH CARE COST SHARING. (a) A health care
3434 cost-sharing organization shall facilitate health care cost
3535 sharing among its participants by matching participants with health
3636 care bills to participants with the ability to provide financial
3737 assistance in accordance with the criteria established by the
3838 organization.
3939 (b) In facilitating health care cost sharing, a health care
4040 cost-sharing organization:
4141 (1) shall collect resources from participants to
4242 provide payments for a participant's health care bills through the
4343 direct contributions from one participant to another without the
4444 pooling of accounts; and
4545 (2) may not have a financial interest in a
4646 participant's decision on whether to share money.
4747 Sec. 1682.0052. COMMUNITY MAINTENANCE. A health care
4848 cost-sharing organization may suggest an amount that participants
4949 may voluntarily contribute to community maintenance. The
5050 organization may not require a participant to make a contribution
5151 or assume a risk for the community maintenance.
5252 Sec. 1682.0053. REQUIRED DISCLOSURES. (a) A health care
5353 cost-sharing organization shall provide the following written
5454 disclosure to prospective participants and annually to
5555 participants:
5656 "Health care cost-sharing organizations facilitate the
5757 sharing of health care expenses but are not insurance companies.
5858 Neither their guidelines nor their plans of operation are an
5959 insurance policy. Whether anyone chooses to assist you with your
6060 health care bills will be totally voluntary because no other
6161 participant will be compelled by law to contribute toward your
6262 health care bills.
6363 "As such, participation in the cost-sharing coverage or a
6464 subscription to any of its documents should never be considered to
6565 be or treated like insurance. Regardless of whether you receive any
6666 payment for health care expenses or whether this organization
6767 continues to operate, you are always personally responsible for the
6868 payment of your own health care bills. Complaints concerning any
6969 health care cost-sharing organization may be reported to the office
7070 of the Texas attorney general."
7171 (b) A health care cost-sharing organization shall provide a
7272 written disclosure of all administrative fees and costs to
7373 prospective participants and annually to participants.
7474 Sec. 1682.0054. MONTHLY STATEMENT. A health care
7575 cost-sharing organization shall provide a written monthly
7676 statement to all participants that lists:
7777 (1) the total dollar amount of qualified needs
7878 submitted to the organization; and
7979 (2) the amount actually published or assigned to
8080 participants for their contribution.
8181 Sec. 1682.0055. PARTICIPANT CARD. A health care
8282 cost-sharing organization shall ensure that a card issued to a
8383 participant for the purpose of presentation to a health care
8484 provider clearly indicates that the participant is part of a health
8585 care cost-sharing organization that is not engaging in the business
8686 of insurance.
8787 Sec. 1682.0056. DISCOUNT HEALTH CARE PROGRAM PROHIBITED. A
8888 health care cost-sharing organization may not operate a discount
8989 health care program as defined by Section 7001.001.
9090 Sec. 1682.0057. COMPLAINT; INJUNCTION. (a) A person who
9191 reasonably believes that a health care cost-sharing organization is
9292 not complying with this chapter may file a written complaint with
9393 the attorney general.
9494 (b) The attorney general may investigate a complaint
9595 received under Subsection (a). If the attorney general determines
9696 that a violation has occurred, the attorney general may bring a
9797 civil action in the name of the state for an injunction against a
9898 health care cost-sharing organization that is violating this
9999 chapter.
100100 SECTION 3. This Act takes effect September 1, 2021.
