9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the creation of the criminal offense of impersonating a
612 private investigator.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter P, Chapter 1702, Occupations Code, is
915 amended by adding Section 1702.3876 to read as follows:
1016 Sec. 1702.3876. IMPERSONATING PRIVATE INVESTIGATOR;
1117 OFFENSE. (a) A person commits an offense if the person:
1218 (1) impersonates a private investigator with the
1319 intent to induce another to submit to the person's pretended
1420 authority or to rely on the person's pretended acts of a private
1521 investigator; or
1622 (2) knowingly purports to exercise any function that
1723 requires licensure as a private investigator.
1824 (b) An offense under this section is a Class A misdemeanor,
1925 except that the offense is a felony of the third degree if it is
2026 shown on the trial of the offense that the defendant has previously
2127 been convicted of an offense under this section.
2228 SECTION 2. This Act takes effect September 1, 2021.
