| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Subchapter P, Chapter 1702, Occupations Code, is |
|---|
| 9 | 15 | | amended by adding Section 1702.3876 to read as follows: |
|---|
| 10 | 16 | | Sec. 1702.3876. IMPERSONATING PRIVATE INVESTIGATOR; |
|---|
| 11 | 17 | | OFFENSE. (a) A person commits an offense if the person: |
|---|
| 12 | 18 | | (1) impersonates a private investigator with the |
|---|
| 13 | 19 | | intent to induce another to submit to the person's pretended |
|---|
| 14 | 20 | | authority or to rely on the person's pretended acts of a private |
|---|
| 15 | 21 | | investigator; or |
|---|
| 16 | 22 | | (2) knowingly purports to exercise any function that |
|---|
| 17 | 23 | | requires licensure as a private investigator. |
|---|
| 18 | 24 | | (b) An offense under this section is a Class A misdemeanor, |
|---|
| 19 | 25 | | except that the offense is a felony of the third degree if it is |
|---|
| 20 | 26 | | shown on the trial of the offense that the defendant has previously |
|---|
| 21 | 27 | | been convicted of an offense under this section. |

| 22 | 28 | | SECTION 2. This Act takes effect September 1, 2021. |
