105 AN ACT
11- relating to the limitations period for certain criminal offenses
12- based on assaultive conduct.
6+ relating to the limitations period for certain offenses involving
7+ dating or family violence.
138 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
149 SECTION 1. Article 12.01, Code of Criminal Procedure, is
1510 amended to read as follows:
1611 Art. 12.01. FELONIES. Except as provided in Article 12.03,
1712 felony indictments may be presented within these limits, and not
1813 afterward:
1914 (1) no limitation:
2015 (A) murder and manslaughter;
2116 (B) sexual assault under Section 22.011(a)(2),
2217 Penal Code, or aggravated sexual assault under Section
2318 22.021(a)(1)(B), Penal Code;
2419 (C) sexual assault, if:
2520 (i) during the investigation of the offense
2621 biological matter is collected and the matter:
2722 (a) has not yet been subjected to
2823 forensic DNA testing; or
2924 (b) has been subjected to forensic DNA
3025 testing and the testing results show that the matter does not match
3126 the victim or any other person whose identity is readily
3227 ascertained; or
3328 (ii) probable cause exists to believe that
3429 the defendant has committed the same or a similar sex offense
3530 against five or more victims;
3631 (D) continuous sexual abuse of young child or
3732 children under Section 21.02, Penal Code;
3833 (E) indecency with a child under Section 21.11,
3934 Penal Code;
4035 (F) an offense involving leaving the scene of an
4136 accident under Section 550.021, Transportation Code, if the
4237 accident resulted in the death of a person;
4338 (G) trafficking of persons under Section
4439 20A.02(a)(7) or (8), Penal Code;
4540 (H) continuous trafficking of persons under
4641 Section 20A.03, Penal Code; or
4742 (I) compelling prostitution under Section
4843 43.05(a)(2), Penal Code;
4944 (2) ten years from the date of the commission of the
5045 offense:
5146 (A) theft of any estate, real, personal or mixed,
5247 by an executor, administrator, guardian or trustee, with intent to
5348 defraud any creditor, heir, legatee, ward, distributee,
5449 beneficiary or settlor of a trust interested in such estate;
5550 (B) theft by a public servant of government
5651 property over which the public servant exercises control in the
5752 public servant's official capacity;
5853 (C) forgery or the uttering, using or passing of
5954 forged instruments;
6055 (D) injury to an elderly or disabled individual
6156 punishable as a felony of the first degree under Section 22.04,
6257 Penal Code;
6358 (E) sexual assault, except as provided by
6459 Subdivision (1) or (7);
6560 (F) arson;
6661 (G) trafficking of persons under Section
6762 20A.02(a)(1), (2), (3), or (4), Penal Code; or
6863 (H) compelling prostitution under Section
6964 43.05(a)(1), Penal Code;
7065 (3) seven years from the date of the commission of the
7166 offense:
7267 (A) misapplication of fiduciary property or
7368 property of a financial institution;
7469 (B) securing execution of document by deception;
7570 (C) a felony violation under Chapter 162, Tax
7671 Code;
7772 (D) false statement to obtain property or credit
7873 under Section 32.32, Penal Code;
7974 (E) money laundering;
8075 (F) credit card or debit card abuse under Section
8176 32.31, Penal Code;
8277 (G) fraudulent use or possession of identifying
8378 information under Section 32.51, Penal Code;
8479 (H) exploitation of a child, elderly individual,
8580 or disabled individual under Section 32.53, Penal Code;
8681 (I) health care fraud under Section 35A.02, Penal
8782 Code; or
8883 (J) bigamy under Section 25.01, Penal Code,
8984 except as provided by Subdivision (6);
9085 (4) five years from the date of the commission of the
9186 offense:
9287 (A) theft or robbery;
9388 (B) except as provided by Subdivision (5),
9489 kidnapping or burglary;
9590 (C) injury to an elderly or disabled individual
9691 that is not punishable as a felony of the first degree under Section
9792 22.04, Penal Code;
9893 (D) abandoning or endangering a child; [or]
9994 (E) insurance fraud;
10095 (F) assault under Section 22.01, Penal Code, if
10196 the assault was committed against a person whose relationship to or
10297 association with the defendant is described by Section 71.0021(b),
10398 71.003, or 71.005, Family Code;
10499 (G) continuous violence against the family under
105100 Section 25.11, Penal Code; or
106101 (H) aggravated assault under Section 22.02,
107102 Penal Code;
108103 (5) if the investigation of the offense shows that the
109104 victim is younger than 17 years of age at the time the offense is
110105 committed, 20 years from the 18th birthday of the victim of one of
111106 the following offenses:
112107 (A) sexual performance by a child under Section
113108 43.25, Penal Code;
114109 (B) aggravated kidnapping under Section
115110 20.04(a)(4), Penal Code, if the defendant committed the offense
116111 with the intent to violate or abuse the victim sexually; or
117112 (C) burglary under Section 30.02, Penal Code, if
118113 the offense is punishable under Subsection (d) of that section and
119114 the defendant committed the offense with the intent to commit an
120115 offense described by Subdivision (1)(B) or (D) of this article or
121116 Paragraph (B) of this subdivision;
122117 (6) ten years from the 18th birthday of the victim of
123118 the offense:
124119 (A) trafficking of persons under Section
125120 20A.02(a)(5) or (6), Penal Code;
126121 (B) injury to a child under Section 22.04, Penal
127122 Code; or
128123 (C) bigamy under Section 25.01, Penal Code, if
129124 the investigation of the offense shows that the person, other than
130125 the legal spouse of the defendant, whom the defendant marries or
131126 purports to marry or with whom the defendant lives under the
132127 appearance of being married is younger than 18 years of age at the
133128 time the offense is committed;
134129 (7) two years from the date the offense was
135130 discovered: sexual assault punishable as a state jail felony under
136131 Section 22.011(f)(2), Penal Code; or
137132 (8) three years from the date of the commission of the
138133 offense: all other felonies.
139134 SECTION 2. Article 12.02, Code of Criminal Procedure, is
140135 amended to read as follows:
141136 Art. 12.02. MISDEMEANORS. (a) Except as provided by
142137 Subsection (b), the following charging instruments may be presented
143138 within two years from the date of the commission of the offense, and
144139 not afterward:
145140 (1) an [An] indictment or information for any Class A
146141 or Class B misdemeanor; and
147142 (2) a [may be presented within two years from the date
148143 of the commission of the offense, and not afterward.
149144 [(b) A] complaint or information for any Class C
150145 misdemeanor.
151146 (b) An indictment, information, or complaint, as
152147 applicable, for assault under Section 22.01, Penal Code, may be
153148 presented within three [two] years from the date of the commission
154149 of the offense, and not afterward, if the offense:
155150 (1) is punishable as a misdemeanor; and
156151 (2) was committed against a person whose relationship
157152 to or association with the defendant is described by Section
158153 71.0021(b), 71.003, or 71.005, Family Code.
159154 SECTION 3. The change in law made by this Act does not apply
160155 to an offense if the prosecution of that offense becomes barred by
161156 limitation before the effective date of this Act. The prosecution
162157 of that offense remains barred as if this Act had not taken effect.
163158 SECTION 4. This Act takes effect September 1, 2021.
