9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 24, Property Code, is amended by adding | |
11 | 11 | Section 24.012 to read as follows: | |
12 | 12 | Sec. 24.012. TEMPORARY ABATEMENT OF EVICTION OF RESIDENTIAL | |
13 | 13 | TENANT DURING PANDEMIC. (a) In this section: | |
14 | 14 | (1) "Pandemic disease" means an infectious disease | |
15 | 15 | that spreads to a significant portion of the population of a | |
16 | 16 | country, multiple countries, or the world and that poses a | |
17 | 17 | substantial risk of a significant number of human fatalities, | |
18 | 18 | illnesses, or permanent long-term disabilities. | |
19 | 19 | (2) "State of disaster" means a state of disaster | |
20 | 20 | declared by the governor under Section 418.014, Government Code. | |
21 | 21 | (b) An action under this chapter to evict a residential | |
22 | 22 | tenant is automatically abated without a court order during the | |
23 | 23 | period a state of disaster related to a pandemic disease is in | |
24 | 24 | effect. | |
25 | 25 | (c) During the period a state of disaster related to a | |
26 | 26 | pandemic disease is in effect, an officer may not execute a writ of | |
27 | 27 | possession relating to the eviction of a residential tenant. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2022. |
