77 relating to a temporary abatement of evictions of residential
88 tenants during a pandemic.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 24, Property Code, is amended by adding
1111 Section 24.012 to read as follows:
1212 Sec. 24.012. TEMPORARY ABATEMENT OF EVICTION OF RESIDENTIAL
1313 TENANT DURING PANDEMIC. (a) In this section:
1414 (1) "Pandemic disease" means an infectious disease
1515 that spreads to a significant portion of the population of a
1616 country, multiple countries, or the world and that poses a
1717 substantial risk of a significant number of human fatalities,
1818 illnesses, or permanent long-term disabilities.
1919 (2) "State of disaster" means a state of disaster
2020 declared by the governor under Section 418.014, Government Code.
2121 (b) An action under this chapter to evict a residential
2222 tenant is automatically abated without a court order during the
2323 period a state of disaster related to a pandemic disease is in
2424 effect.
2525 (c) During the period a state of disaster related to a
2626 pandemic disease is in effect, an officer may not execute a writ of
2727 possession relating to the eviction of a residential tenant.
2828 SECTION 2. This Act takes effect September 1, 2022.
