 A BILL TO BE ENTITLED
 AN ACT
 relating to a temporary abatement of evictions of residential
 tenants during a pandemic.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 24, Property Code, is amended by adding
 Section 24.012 to read as follows:
 Sec. 24.012.  TEMPORARY ABATEMENT OF EVICTION OF RESIDENTIAL
 TENANT DURING PANDEMIC. (a) In this section:
 (1)  "Pandemic disease" means an infectious disease
 that spreads to a significant portion of the population of a
 country, multiple countries, or the world and that poses a
 substantial risk of a significant number of human fatalities,
 illnesses, or permanent long-term disabilities.
 (2)  "State of disaster" means a state of disaster
 declared by the governor under Section 418.014, Government Code.
 (b)  An action under this chapter to evict a residential
 tenant is automatically abated without a court order during the
 period a state of disaster related to a pandemic disease is in
 effect.
 (c)  During the period a state of disaster related to a
 pandemic disease is in effect, an officer may not execute a writ of
 possession relating to the eviction of a residential tenant.
 SECTION 2.  This Act takes effect September 1, 2022.
