9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to use of project funds of municipal development
612 districts.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 377.072(c), Local Government Code, is
915 amended to read as follows:
1016 (c) Except as provided by Subsections (d) and (e), the
1117 district may use money in the development project fund only to:
1218 (1) pay the costs of planning, acquiring,
1319 establishing, developing, constructing, or renovating one or more
1420 development projects located:
1521 (A) in the district; or
1622 (B) outside the district, if:
1723 (i) the project is located in the
1824 extraterritorial jurisdiction of the municipality that created the
1925 district;
2026 (ii) the board determines that the
2127 development project will provide an economic benefit to the
2228 district; and
2329 (iii) the following entities, as
2430 applicable, by resolution approve the development project:
2531 (a) the municipality that created the
2632 district; and
2733 (b) each municipality in whose
2834 corporate limits or extraterritorial jurisdiction the project is
2935 located;
3036 (2) pay the principal of, interest on, and other costs
3137 relating to bonds or other obligations issued by the district or to
3238 refund bonds or other obligations; or
3339 (3) pay the costs of operating or maintaining one or
3440 more development projects during the planning, acquisition,
3541 establishment, development, construction, or renovation or while
3642 bonds or other obligations for the planning, acquisition,
3743 establishment, development, construction, or renovation are
3844 outstanding.
3945 SECTION 2. This Act takes effect immediately if it receives
4046 a vote of two-thirds of all the members elected to each house, as
4147 provided by Section 39, Article III, Texas Constitution. If this
4248 Act does not receive the vote necessary for immediate effect, this
4349 Act takes effect September 1, 2021.
