11+ A BILL TO BE ENTITLED
412 AN ACT
513 relating to the creation of a work group on blockchain matters
614 concerning this state.
715 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
816 SECTION 1. (a) In this section:
917 (1) "Blockchain" includes digital assets, virtual
1018 currency, and the integration of smart contracts.
1119 (2) "Work group" means the work group on blockchain
1220 matters established under this section.
1321 (b) The work group on blockchain matters is composed of the
1422 following 16 members:
1523 (1) one member of the house of representatives
1624 appointed by the speaker of the house of representatives;
1725 (2) one member of the senate appointed by the
1826 lieutenant governor;
1927 (3) two members representing institutions of higher
2028 education appointed by the governor;
2129 (4) one ex-officio member representing the Department
2230 of Information Resources appointed by the governor;
2331 (5) one ex-officio member representing the secretary
2432 of state appointed by the governor; and
2533 (6) 10 members of the public, five of whom are
2634 appointed by the speaker of the house of representatives and five of
2735 whom are appointed by the lieutenant governor, who:
2836 (A) have knowledge and experience in blockchain
2937 technology; or
3038 (B) represent an industry that would benefit from
3139 the use of blockchain technology.
3240 (c) The governor shall designate a member of the work group
3341 appointed under Subsection (b)(3) of this section to serve as chair
3442 of the work group. The members of the work group appointed under
3543 Subsections (b)(1) and (2) of this section shall serve as co-vice
3644 chairs of the work group.
3745 (d) A member of the work group may not receive compensation
3846 for serving on the work group but is entitled to reimbursement for
3947 expenses incurred by the member in the performance of official
4048 duties as a member of the work group as provided by the General
4149 Appropriations Act.
4250 (e) The Department of Information Resources shall provide
4351 to the work group the administrative support necessary to implement
4452 this Act.
4553 (f) The work group shall meet at the call of the chair.
4654 (g) The work group shall develop a master plan for the
4755 expansion of the blockchain industry in this state and recommend
4856 policies and state investments in connection with blockchain
4957 technology. In developing the master plan, the work group shall:
5058 (1) identify economic growth and development
5159 opportunities presented by blockchain technology;
5260 (2) assess the existing blockchain industry in this
5361 state;
5462 (3) review workforce needs and academic programs
5563 required to build blockchain expertise across all relevant
5664 industries; and
5765 (4) make any legislative recommendations that will
5866 help promote innovation and economic growth by reducing barriers to
5967 and expediting the expansion of the state's blockchain industry
6068 based on its findings under Subdivisions (1)-(3) of this
6169 subsection.
6270 (h) The chair of the work group may create sub-work groups
6371 at the chair's discretion for the efficient operation of the work
6472 group. The chair shall appoint the chair of each sub-work group.
6573 The chair of a sub-work group may invite other members of the work
6674 group to serve on the sub-work group. A sub-work group may consult
6775 with subject matter experts.
6876 (i) Not later than October 31, 2022, the work group shall
6977 submit a report that includes the master plan developed under
7078 Subsection (g) of this section and any findings and recommendations
7179 from the sub-work groups appointed under Subsection (h) of this
7280 section to each standing committee of the senate and house of
7381 representatives with primary jurisdiction over economic
7482 development or technology issues.
7583 (j) The work group may adopt rules, procedures, and policies
7684 as necessary to administer this section and implement the
7785 responsibilities of the work group.
7886 (k) This Act expires and the work group is abolished June
7987 30, 2023.
8088 SECTION 2. As soon as practicable, but not later than
8189 October 1, 2021, the governor, lieutenant governor, and speaker of
8290 the house of representatives shall appoint the members of the work
8391 group on blockchain matters established by this Act.
8492 SECTION 3. Not later than November 1, 2021, the work group
8593 on blockchain matters shall hold its initial meeting.
8694 SECTION 4. This Act takes effect September 1, 2021.
