| 7 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 15 | | SECTION 1. Section 437.202, Government Code, is amended by |
|---|
| 9 | 16 | | adding Subsection (a-1) to read as follows: |
|---|
| 10 | 17 | | (a-1) In addition to the leave provided under Subsection |
|---|
| 11 | 18 | | (a), a person described by Subsection (a) called to state active |
|---|
| 12 | 19 | | duty by the governor or another appropriate authority in response |
|---|
| 13 | 20 | | to a disaster is entitled to a paid leave of absence from the |
|---|
| 14 | 21 | | person's duties for each day the person is called to active duty |
|---|
| 15 | 22 | | during the disaster, not to exceed seven workdays in a fiscal year. |
|---|
| 16 | 23 | | During a leave of absence under this subsection, the person may not |
|---|
| 17 | 24 | | be subjected to loss of time, efficiency rating, personal time, |
|---|
| 18 | 25 | | sick leave, or vacation time. For purposes of this subsection, |
|---|
| 19 | 26 | | "disaster" has the meaning assigned by Section 418.004. |

| 20 | 27 | | SECTION 2. This Act takes effect September 1, 2021. |
