4	10		AN ACT
5	11		relating to the construction, maintenance, rehabilitation, and
6	12		removal of dams by the Upper Brushy Creek Water Control and
7	13		Improvement District.
8	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	15		SECTION 1. Section 1, Chapter 341, Acts of the 55th
10	16		Legislature, Regular Session, 1957, is amended to read as follows:
11	17		Sec. 1. The creation and organization of the Brushy Creek
12	18		Water Control and Improvement District No. 1 of Williamson and
13	19		Milam Counties[, hereinafter referred to as "District,"] is hereby
14	20		in all things validated. Without limiting the generalization of the
15	21		foregoing, it is specifically provided that the order adopted by
16	22		the State Board of Water Engineers of Texas on the first day of
17	23		November, 1956, creating said District; the election held within
18	24		said District on the eighth day of January, 1957, for the
19	25		confirmation of the organization of said District, the election of
20	26		directors, and for the issuance of preliminary bonds and levy of
21	27		taxes in payment therefor, and all proceedings in connection with
22	28		the order and said election are in all respects validated and when
23	29		said preliminary bonds have been issued and delivered to the
24	30		purchaser or purchasers thereof, they shall be incontestable.
25	31		SECTION 2. Chapter 341, Acts of the 55th Legislature,
26	32		Regular Session, 1957, is amended by adding Sections 1A and 8A to
27	33		read as follows:
28	34		Sec. 1A. In this chapter, "district" means the Upper Brushy
29	35		Creek Water Control and Improvement District and the Lower Brushy
30	36		Creek Water Control and Improvement District.
31	37		Sec. 8A. The Upper Brushy Creek Water Control and
32	38		Improvement District is not required to comply with municipal
33	39		regulations regarding the construction, maintenance,
34	40		rehabilitation, or removal of dams.
35	41		SECTION 3. This Act takes effect immediately if it receives
36	42		a vote of two-thirds of all the members elected to each house, as
37	43		provided by Section 39, Article III, Texas Constitution. If this
38	44		Act does not receive the vote necessary for immediate effect, this
39	45		Act takes effect September 1, 2021.
