410 AN ACT
511 relating to a defense to prosecution for certain offenses involving
612 possession of small amounts of controlled substances, marihuana,
713 dangerous drugs, or abusable volatile chemicals, or possession of
814 drug paraphernalia for defendants seeking assistance for a
915 suspected overdose.
1016 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1117 SECTION 1. This Act may be cited as the Jessica Sosa Act.
1218 SECTION 2. Section 481.115, Health and Safety Code, is
1319 amended by adding Subsections (g), (h), and (i) to read as follows:
1420 (g) It is a defense to prosecution for an offense punishable
1521 under Subsection (b) that the actor:
1622 (1) was the first person to request emergency medical
1723 assistance in response to the possible overdose of another person
1824 and:
1925 (A) made the request for medical assistance
2026 during an ongoing medical emergency;
2127 (B) remained on the scene until the medical
2228 assistance arrived; and
2329 (C) cooperated with medical assistance and law
2430 enforcement personnel; or
2531 (2) was the victim of a possible overdose for which
2632 emergency medical assistance was requested, by the actor or by
2733 another person, during an ongoing medical emergency.
2834 (h) The defense to prosecution provided by Subsection (g) is
2935 not available if:
3036 (1) at the time the request for emergency medical
3137 assistance was made:
3238 (A) a peace officer was in the process of
3339 arresting the actor or executing a search warrant describing the
3440 actor or the place from which the request for medical assistance was
3541 made; or
3642 (B) the actor is committing another offense,
3743 other than an offense punishable under Section 481.1151(b)(1),
3844 481.116(b), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
3945 481.121(b)(1) or (2), or an offense under Section 481.119(b),
4046 481.125(a), 483.041(a), or 485.031(a);
4147 (2) the actor has been previously convicted of or
4248 placed on deferred adjudication community supervision for an
4349 offense under this chapter or Chapter 483 or 485;
4450 (3) the actor was acquitted in a previous proceeding
4551 in which the actor successfully established the defense under that
4652 subsection or Section 481.1151(c), 481.116(f), 481.1161(c),
4753 481.117(f), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
4854 483.041(e), or 485.031(c); or
4955 (4) at any time during the 18-month period preceding
5056 the date of the commission of the instant offense, the actor
5157 requested emergency medical assistance in response to the possible
5258 overdose of the actor or another person.
5359 (i) The defense to prosecution provided by Subsection (g)
5460 does not preclude the admission of evidence obtained by law
5561 enforcement resulting from the request for emergency medical
5662 assistance if that evidence pertains to an offense for which the
5763 defense described by Subsection (g) is not available.
5864 SECTION 3. Section 481.1151, Health and Safety Code, is
5965 amended by adding Subsections (c), (d), and (e) to read as follows:
6066 (c) It is a defense to prosecution for an offense punishable
6167 under Subsection (b)(1) that the actor:
6268 (1) was the first person to request emergency medical
6369 assistance in response to the possible overdose of another person
6470 and:
6571 (A) made the request for medical assistance
6672 during an ongoing medical emergency;
6773 (B) remained on the scene until the medical
6874 assistance arrived; and
6975 (C) cooperated with medical assistance and law
7076 enforcement personnel; or
7177 (2) was the victim of a possible overdose for which
7278 emergency medical assistance was requested, by the actor or by
7379 another person, during an ongoing medical emergency.
7480 (d) The defense to prosecution provided by Subsection (c) is
7581 not available if:
7682 (1) at the time the request for emergency medical
7783 assistance was made:
7884 (A) a peace officer was in the process of
7985 arresting the actor or executing a search warrant describing the
8086 actor or the place from which the request for medical assistance was
8187 made; or
8288 (B) the actor is committing another offense,
8389 other than an offense punishable under Section 481.115(b),
8490 481.116(b), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
8591 481.121(b)(1) or (2), or an offense under Section 481.119(b),
8692 481.125(a), 483.041(a), or 485.031(a);
8793 (2) the actor has been previously convicted of or
8894 placed on deferred adjudication community supervision for an
8995 offense under this chapter or Chapter 483 or 485;
9096 (3) the actor was acquitted in a previous proceeding
9197 in which the actor successfully established the defense under that
9298 subsection or Section 481.115(g), 481.116(f), 481.1161(c),
9399 481.117(f), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
94100 483.041(e), or 485.031(c); or
95101 (4) at any time during the 18-month period preceding
96102 the date of the commission of the instant offense, the actor
97103 requested emergency medical assistance in response to the possible
98104 overdose of the actor or another person.
99105 (e) The defense to prosecution provided by Subsection (c)
100106 does not preclude the admission of evidence obtained by law
101107 enforcement resulting from the request for emergency medical
102108 assistance if that evidence pertains to an offense for which the
103109 defense described by Subsection (c) is not available.
104110 SECTION 4. Section 481.116, Health and Safety Code, is
105111 amended by adding Subsections (f), (g), and (h) to read as follows:
106112 (f) It is a defense to prosecution for an offense punishable
107113 under Subsection (b) that the actor:
108114 (1) was the first person to request emergency medical
109115 assistance in response to the possible overdose of another person
110116 and:
111117 (A) made the request for medical assistance
112118 during an ongoing medical emergency;
113119 (B) remained on the scene until the medical
114120 assistance arrived; and
115121 (C) cooperated with medical assistance and law
116122 enforcement personnel; or
117123 (2) was the victim of a possible overdose for which
118124 emergency medical assistance was requested, by the actor or by
119125 another person, during an ongoing medical emergency.
120126 (g) The defense to prosecution provided by Subsection (f) is
121127 not available if:
122128 (1) at the time the request for emergency medical
123129 assistance was made:
124130 (A) a peace officer was in the process of
125131 arresting the actor or executing a search warrant describing the
126132 actor or the place from which the request for medical assistance was
127133 made; or
128134 (B) the actor is committing another offense,
129135 other than an offense punishable under Section 481.115(b),
130136 481.1151(b)(1), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
131137 481.121(b)(1) or (2), or an offense under Section 481.119(b),
132138 481.125(a), 483.041(a), or 485.031(a);
133139 (2) the actor has been previously convicted of or
134140 placed on deferred adjudication community supervision for an
135141 offense under this chapter or Chapter 483 or 485;
136142 (3) the actor was acquitted in a previous proceeding
137143 in which the actor successfully established the defense under that
138144 subsection or Section 481.115(g), 481.1151(c), 481.1161(c),
139145 481.117(f), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
140146 483.041(e), or 485.031(c); or
141147 (4) at any time during the 18-month period preceding
142148 the date of the commission of the instant offense, the actor
143149 requested emergency medical assistance in response to the possible
144150 overdose of the actor or another person.
145151 (h) The defense to prosecution provided by Subsection (f)
146152 does not preclude the admission of evidence obtained by law
147153 enforcement resulting from the request for emergency medical
148154 assistance if that evidence pertains to an offense for which the
149155 defense described by Subsection (f) is not available.
150156 SECTION 5. Section 481.1161, Health and Safety Code, is
151157 amended by adding Subsections (c), (d), and (e) to read as follows:
152158 (c) It is a defense to prosecution for an offense punishable
153159 under Subsection (b)(1) or (2) that the actor:
154160 (1) was the first person to request emergency medical
155161 assistance in response to the possible overdose of another person
156162 and:
157163 (A) made the request for medical assistance
158164 during an ongoing medical emergency;
159165 (B) remained on the scene until the medical
160166 assistance arrived; and
161167 (C) cooperated with medical assistance and law
162168 enforcement personnel; or
163169 (2) was the victim of a possible overdose for which
164170 emergency medical assistance was requested, by the actor or by
165171 another person, during an ongoing medical emergency.
166172 (d) The defense to prosecution provided by Subsection (c) is
167173 not available if:
168174 (1) at the time the request for emergency medical
169175 assistance was made:
170176 (A) a peace officer was in the process of
171177 arresting the actor or executing a search warrant describing the
172178 actor or the place from which the request for medical assistance was
173179 made; or
174180 (B) the actor is committing another offense,
175181 other than an offense punishable under Section 481.115(b),
176182 481.1151(b)(1), 481.116(b), 481.117(b), 481.118(b), or
177183 481.121(b)(1) or (2), or an offense under Section 481.119(b),
178184 481.125(a), 483.041(a), or 485.031(a);
179185 (2) the actor has been previously convicted of or
180186 placed on deferred adjudication community supervision for an
181187 offense under this chapter or Chapter 483 or 485;
182188 (3) the actor was acquitted in a previous proceeding
183189 in which the actor successfully established the defense under that
184190 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
185191 481.117(f), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
186192 483.041(e), or 485.031(c); or
187193 (4) at any time during the 18-month period preceding
188194 the date of the commission of the instant offense, the actor
189195 requested emergency medical assistance in response to the possible
190196 overdose of the actor or another person.
191197 (e) The defense to prosecution provided by Subsection (c)
192198 does not preclude the admission of evidence obtained by law
193199 enforcement resulting from the request for emergency medical
194200 assistance if that evidence pertains to an offense for which the
195201 defense described by Subsection (c) is not available.
196202 SECTION 6. Section 481.117, Health and Safety Code, is
197203 amended by adding Subsections (f), (g), and (h) to read as follows:
198204 (f) It is a defense to prosecution for an offense punishable
199205 under Subsection (b) that the actor:
200206 (1) was the first person to request emergency medical
201207 assistance in response to the possible overdose of another person
202208 and:
203209 (A) made the request for medical assistance
204210 during an ongoing medical emergency;
205211 (B) remained on the scene until the medical
206212 assistance arrived; and
207213 (C) cooperated with medical assistance and law
208214 enforcement personnel; or
209215 (2) was the victim of a possible overdose for which
210216 emergency medical assistance was requested, by the actor or by
211217 another person, during an ongoing medical emergency.
212218 (g) The defense to prosecution provided by Subsection (f) is
213219 not available if:
214220 (1) at the time the request for emergency medical
215221 assistance was made:
216222 (A) a peace officer was in the process of
217223 arresting the actor or executing a search warrant describing the
218224 actor or the place from which the request for medical assistance was
219225 made; or
220226 (B) the actor is committing another offense,
221227 other than an offense punishable under Section 481.115(b),
222228 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.118(b), or
223229 481.121(b)(1) or (2), or an offense under Section 481.119(b),
224230 481.125(a), 483.041(a), or 485.031(a);
225231 (2) the actor has been previously convicted of or
226232 placed on deferred adjudication community supervision for an
227233 offense under this chapter or Chapter 483 or 485;
228234 (3) the actor was acquitted in a previous proceeding
229235 in which the actor successfully established the defense under that
230236 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
231237 481.1161(c), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
232238 483.041(e), or 485.031(c); or
233239 (4) at any time during the 18-month period preceding
234240 the date of the commission of the instant offense, the actor
235241 requested emergency medical assistance in response to the possible
236242 overdose of the actor or another person.
237243 (h) The defense to prosecution provided by Subsection (f)
238244 does not preclude the admission of evidence obtained by law
239245 enforcement resulting from the request for emergency medical
240246 assistance if that evidence pertains to an offense for which the
241247 defense described by Subsection (f) is not available.
242248 SECTION 7. Section 481.118, Health and Safety Code, is
243249 amended by adding Subsections (f), (g), and (h) to read as follows:
244250 (f) It is a defense to prosecution for an offense punishable
245251 under Subsection (b) that the actor:
246252 (1) was the first person to request emergency medical
247253 assistance in response to the possible overdose of another person
248254 and:
249255 (A) made the request for medical assistance
250256 during an ongoing medical emergency;
251257 (B) remained on the scene until the medical
252258 assistance arrived; and
253259 (C) cooperated with medical assistance and law
254260 enforcement personnel; or
255261 (2) was the victim of a possible overdose for which
256262 emergency medical assistance was requested, by the actor or by
257263 another person, during an ongoing medical emergency.
258264 (g) The defense to prosecution provided by Subsection (f) is
259265 not available if:
260266 (1) at the time the request for emergency medical
261267 assistance was made:
262268 (A) a peace officer was in the process of
263269 arresting the actor or executing a search warrant describing the
264270 actor or the place from which the request for medical assistance was
265271 made; or
266272 (B) the actor is committing another offense,
267273 other than an offense punishable under Section 481.115(b),
268274 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b), or
269275 481.121(b)(1) or (2), or an offense under Section 481.119(b),
270276 481.125(a), 483.041(a), or 485.031(a);
271277 (2) the actor has been previously convicted of or
272278 placed on deferred adjudication community supervision for an
273279 offense under this chapter or Chapter 483 or 485;
274280 (3) the actor was acquitted in a previous proceeding
275281 in which the actor successfully established the defense under that
276282 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
277283 481.1161(c), 481.117(f), 481.119(c), 481.121(c), 481.125(g),
278284 483.041(e), or 485.031(c); or
279285 (4) at any time during the 18-month period preceding
280286 the date of the commission of the instant offense, the actor
281287 requested emergency medical assistance in response to the possible
282288 overdose of the actor or another person.
283289 (h) The defense to prosecution provided by Subsection (f)
284290 does not preclude the admission of evidence obtained by law
285291 enforcement resulting from the request for emergency medical
286292 assistance if that evidence pertains to an offense for which the
287293 defense described by Subsection (f) is not available.
288294 SECTION 8. Section 481.119, Health and Safety Code, is
289295 amended by adding Subsections (c), (d), and (e) to read as follows:
290296 (c) It is a defense to prosecution for an offense under
291297 Subsection (b) that the actor:
292298 (1) was the first person to request emergency medical
293299 assistance in response to the possible overdose of another person
294300 and:
295301 (A) made the request for medical assistance
296302 during an ongoing medical emergency;
297303 (B) remained on the scene until the medical
298304 assistance arrived; and
299305 (C) cooperated with medical assistance and law
300306 enforcement personnel; or
301307 (2) was the victim of a possible overdose for which
302308 emergency medical assistance was requested, by the actor or by
303309 another person, during an ongoing medical emergency.
304310 (d) The defense to prosecution provided by Subsection (c) is
305311 not available if:
306312 (1) at the time the request for emergency medical
307313 assistance was made:
308314 (A) a peace officer was in the process of
309315 arresting the actor or executing a search warrant describing the
310316 actor or the place from which the request for medical assistance was
311317 made; or
312318 (B) the actor is committing another offense,
313319 other than an offense punishable under Section 481.115(b),
314320 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
315321 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
316322 481.125(a), 483.041(a), or 485.031(a);
317323 (2) the actor has been previously convicted of or
318324 placed on deferred adjudication community supervision for an
319325 offense under this chapter or Chapter 483 or 485;
320326 (3) the actor was acquitted in a previous proceeding
321327 in which the actor successfully established the defense under that
322328 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
323329 481.1161(c), 481.117(f), 481.118(f), 481.121(c), 481.125(g),
324330 483.041(e), or 485.031(c); or
325331 (4) at any time during the 18-month period preceding
326332 the date of the commission of the instant offense, the actor
327333 requested emergency medical assistance in response to the possible
328334 overdose of the actor or another person.
329335 (e) The defense to prosecution provided by Subsection (c)
330336 does not preclude the admission of evidence obtained by law
331337 enforcement resulting from the request for emergency medical
332338 assistance if that evidence pertains to an offense for which the
333339 defense described by Subsection (c) is not available.
334340 SECTION 9. Section 481.121, Health and Safety Code, is
335341 amended by adding Subsections (c), (d), and (e) to read as follows:
336342 (c) It is a defense to prosecution for an offense punishable
337343 under Subsection (b)(1) or (2) that the actor:
338344 (1) was the first person to request emergency medical
339345 assistance in response to the possible overdose of another person
340346 and:
341347 (A) made the request for medical assistance
342348 during an ongoing medical emergency;
343349 (B) remained on the scene until the medical
344350 assistance arrived; and
345351 (C) cooperated with medical assistance and law
346352 enforcement personnel; or
347353 (2) was the victim of a possible overdose for which
348354 emergency medical assistance was requested, by the actor or by
349355 another person, during an ongoing medical emergency.
350356 (d) The defense to prosecution provided by Subsection (c) is
351357 not available if:
352358 (1) at the time the request for emergency medical
353359 assistance was made:
354360 (A) a peace officer was in the process of
355361 arresting the actor or executing a search warrant describing the
356362 actor or the place from which the request for medical assistance was
357363 made; or
358364 (B) the actor is committing another offense,
359365 other than an offense punishable under Section 481.115(b),
360366 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b), or
361367 481.118(b), or an offense under Section 481.119(b), 481.125(a),
362368 483.041(a), or 485.031(a);
363369 (2) the actor has been previously convicted of or
364370 placed on deferred adjudication community supervision for an
365371 offense under this chapter or Chapter 483 or 485;
366372 (3) the actor was acquitted in a previous proceeding
367373 in which the actor successfully established the defense under that
368374 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
369375 481.1161(c), 481.117(f), 481.118(f), 481.119(c), 481.125(g),
370376 483.041(e), or 485.031(c); or
371377 (4) at any time during the 18-month period preceding
372378 the date of the commission of the instant offense, the actor
373379 requested emergency medical assistance in response to the possible
374380 overdose of the actor or another person.
375381 (e) The defense to prosecution provided by Subsection (c)
376382 does not preclude the admission of evidence obtained by law
377383 enforcement resulting from the request for emergency medical
378384 assistance if that evidence pertains to an offense for which the
379385 defense described by Subsection (c) is not available.
380386 SECTION 10. Section 481.125, Health and Safety Code, is
381387 amended by adding Subsections (g), (h), and (i) to read as follows:
382388 (g) It is a defense to prosecution for an offense under
383389 Subsection (a) that the actor:
384390 (1) was the first person to request emergency medical
385391 assistance in response to the possible overdose of another person
386392 and:
387393 (A) made the request for medical assistance
388394 during an ongoing medical emergency;
389395 (B) remained on the scene until the medical
390396 assistance arrived; and
391397 (C) cooperated with medical assistance and law
392398 enforcement personnel; or
393399 (2) was the victim of a possible overdose for which
394400 emergency medical assistance was requested, by the actor or by
395401 another person, during an ongoing medical emergency.
396402 (h) The defense to prosecution provided by Subsection (g) is
397403 not available if:
398404 (1) at the time the request for emergency medical
399405 assistance was made:
400406 (A) a peace officer was in the process of
401407 arresting the actor or executing a search warrant describing the
402408 actor or the place from which the request for medical assistance was
403409 made; or
404410 (B) the actor is committing another offense,
405411 other than an offense punishable under Section 481.115(b),
406412 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
407413 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
408414 481.119(b), 483.041(a), or 485.031(a);
409415 (2) the actor has been previously convicted of or
410416 placed on deferred adjudication community supervision for an
411417 offense under this chapter or Chapter 483 or 485;
412418 (3) the actor was acquitted in a previous proceeding
413419 in which the actor successfully established the defense under that
414420 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
415421 481.1161(c), 481.117(f), 481.118(f), 481.119(c), 481.121(c),
416422 483.041(e), or 485.031(c); or
417423 (4) at any time during the 18-month period preceding
418424 the date of the commission of the instant offense, the actor
419425 requested emergency medical assistance in response to the possible
420426 overdose of the actor or another person.
421427 (i) The defense to prosecution provided by Subsection (g)
422428 does not preclude the admission of evidence obtained by law
423429 enforcement resulting from the request for emergency medical
424430 assistance if that evidence pertains to an offense for which the
425431 defense described by Subsection (g) is not available.
426432 SECTION 11. Section 483.041, Health and Safety Code, is
427433 amended by adding Subsections (e), (f), and (g) to read as follows:
428434 (e) It is a defense to prosecution for an offense under
429435 Subsection (a) that the actor:
430436 (1) was the first person to request emergency medical
431437 assistance in response to the possible overdose of another person
432438 and:
433439 (A) made the request for medical assistance
434440 during an ongoing medical emergency;
435441 (B) remained on the scene until the medical
436442 assistance arrived; and
437443 (C) cooperated with medical assistance and law
438444 enforcement personnel; or
439445 (2) was the victim of a possible overdose for which
440446 emergency medical assistance was requested, by the actor or by
441447 another person, during an ongoing medical emergency.
442448 (f) The defense to prosecution provided by Subsection (e) is
443449 not available if:
444450 (1) at the time the request for emergency medical
445451 assistance was made:
446452 (A) a peace officer was in the process of
447453 arresting the actor or executing a search warrant describing the
448454 actor or the place from which the request for medical assistance was
449455 made; or
450456 (B) the actor is committing another offense,
451457 other than an offense punishable under Section 481.115(b),
452458 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
453459 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
454460 481.119(b), 481.125(a), or 485.031(a);
455461 (2) the actor has been previously convicted of or
456462 placed on deferred adjudication community supervision for an
457463 offense under this chapter or Chapter 481 or 485;
458464 (3) the actor was acquitted in a previous proceeding
459465 in which the actor successfully established the defense under that
460466 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
461467 481.1161(c), 481.117(f), 481.118(f), 481.119(c), 481.121(c),
462468 481.125(g), or 485.031(c); or
463469 (4) at any time during the 18-month period preceding
464470 the date of the commission of the instant offense, the actor
465471 requested emergency medical assistance in response to the possible
466472 overdose of the actor or another person.
467473 (g) The defense to prosecution provided by Subsection (e)
468474 does not preclude the admission of evidence obtained by law
469475 enforcement resulting from the request for emergency medical
470476 assistance if that evidence pertains to an offense for which the
471477 defense described by Subsection (e) is not available.
472478 SECTION 12. Section 485.031, Health and Safety Code, is
473479 amended by adding Subsections (c), (d), and (e) to read as follows:
474480 (c) It is a defense to prosecution for an offense under
475481 Subsection (a) that the actor:
476482 (1) was the first person to request emergency medical
477483 assistance in response to the possible overdose of another person
478484 and:
479485 (A) made the request for medical assistance
480486 during an ongoing medical emergency;
481487 (B) remained on the scene until the medical
482488 assistance arrived; and
483489 (C) cooperated with medical assistance and law
484490 enforcement personnel; or
485491 (2) was the victim of a possible overdose for which
486492 emergency medical assistance was requested, by the actor or by
487493 another person, during an ongoing medical emergency.
488494 (d) The defense to prosecution provided by Subsection (c) is
489495 not available if:
490496 (1) at the time the request for emergency medical
491497 assistance was made:
492498 (A) a peace officer was in the process of
493499 arresting the actor or executing a search warrant describing the
494500 actor or the place from which the request for medical assistance was
495501 made; or
496502 (B) the actor is committing another offense,
497503 other than an offense punishable under Section 481.115(b),

499505 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
500506 481.119(b), 481.125(a), or 483.041(a);
501507 (2) the actor has been previously convicted of or
502508 placed on deferred adjudication community supervision for an
503509 offense under this chapter or Chapter 481 or 483;
504510 (3) the actor was acquitted in a previous proceeding
505511 in which the actor successfully established the defense under that
506512 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
507513 481.1161(c), 481.117(f), 481.118(f), 481.119(c), 481.121(c),
508514 481.125(g), or 483.041(e); or
509515 (4) at any time during the 18-month period preceding
510516 the date of the commission of the instant offense, the actor
511517 requested emergency medical assistance in response to the possible
512518 overdose of the actor or another person.
513519 (e) The defense to prosecution provided by Subsection (c)
514520 does not preclude the admission of evidence obtained by law
515521 enforcement resulting from the request for emergency medical
516522 assistance if that evidence pertains to an offense for which the
517523 defense described by Subsection (c) is not available.
518524 SECTION 13. The change in law made by this Act applies only
519525 to an offense committed on or after the effective date of this Act.
520526 An offense committed before the effective date of this Act is
521527 governed by the law in effect on the date the offense was committed,
522528 and the former law is continued in effect for that purpose. For
523529 purposes of this section, an offense was committed before the
524530 effective date of this Act if any element of the offense occurred
525531 before that date.
526532 SECTION 14. This Act takes effect September 1, 2021.
