5 | 11 | | relating to the taking of unbanded pen-reared pheasant and quail by |

6 | 12 | | certain landowners. |

7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Chapter 42, Parks and Wildlife Code, is amended |
---|
9 | 15 | | by adding Section 42.0211 to read as follows: |
---|
10 | 16 | | Sec. 42.0211. TAKING OF UNBANDED PEN-REARED PHEASANT OR |
---|
11 | 17 | | QUAIL BY CERTAIN LANDOWNERS. (a) This section applies only to: |
---|
12 | 18 | | (1) noncommercial activity; and |
---|
13 | 19 | | (2) the taking of pheasant or quail on a property of at |
---|
14 | 20 | | least five contiguous acres. |
---|
15 | 21 | | (b) Notwithstanding any other law requiring the banding of a |
---|
16 | 22 | | bird, a person, or the person's guest when accompanied by the |
---|
17 | 23 | | person, may take on the person's property unbanded pen-reared |
---|
18 | 24 | | pheasant or quail. |
---|
19 | 25 | | (c) Nothing in this section: |
---|
20 | 26 | | (1) affects the requirement to acquire a license under |
---|
21 | 27 | | Section 45.001 for the propagation of game birds; or |
---|
22 | 28 | | (2) authorizes a person to: |
---|
23 | 29 | | (A) exceed a bag limit for pheasant or quail; or |
---|
24 | 30 | | (B) take pheasant or quail during a closed |
---|
25 | 31 | | season. |
---|
26 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
---|
27 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 36 | | Act takes effect September 1, 2021. |
