9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the taking of unbanded pen-reared pheasant and quail by
612 certain landowners.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Chapter 42, Parks and Wildlife Code, is amended
915 by adding Section 42.0211 to read as follows:
1016 Sec. 42.0211. TAKING OF UNBANDED PEN-REARED PHEASANT OR
1117 QUAIL BY CERTAIN LANDOWNERS. (a) This section applies only to:
1218 (1) noncommercial activity; and
1319 (2) the taking of pheasant or quail on a property of at
1420 least five contiguous acres.
1521 (b) Notwithstanding any other law requiring the banding of a
1622 bird, a person, or the person's guest when accompanied by the
1723 person, may take on the person's property unbanded pen-reared
1824 pheasant or quail.
1925 (c) Nothing in this section:
2026 (1) affects the requirement to acquire a license under
2127 Section 45.001 for the propagation of game birds; or
2228 (2) authorizes a person to:
2329 (A) exceed a bag limit for pheasant or quail; or
2430 (B) take pheasant or quail during a closed
2531 season.
2632 SECTION 2. This Act takes effect immediately if it receives
2733 a vote of two-thirds of all the members elected to each house, as
2834 provided by Section 39, Article III, Texas Constitution. If this
2935 Act does not receive the vote necessary for immediate effect, this
3036 Act takes effect September 1, 2021.
