412 AN ACT
513 relating to the sale of alcoholic beverages in areas annexed by
614 certain municipalities.
715 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
816 SECTION 1. Section 251.72, Alcoholic Beverage Code, is
917 amended to read as follows:
1018 Sec. 251.72. CHANGE OF STATUS. Except as provided in
1119 Sections 251.725, 251.726, 251.727, 251.73, and 251.80, an
1220 authorized voting unit that has exercised or may exercise the right
1321 of local option retains the status adopted, whether absolute
1422 prohibition or legalization of the sale of alcoholic beverages of
1523 one or more of the various types and alcoholic contents on which an
1624 issue may be submitted under the terms of Section 501.035, Election
1725 Code, until that status is changed by a subsequent local option
1826 election in the same authorized voting unit.
1927 SECTION 2. Subchapter D, Chapter 251, Alcoholic Beverage
2028 Code, is amended by adding Section 251.727 to read as follows:
2129 Sec. 251.727. CHANGE OF STATUS FOR TERRITORY ANNEXED BY
2230 MUNICIPALITIES IN CERTAIN COUNTIES. (a) This section applies only
2331 to:
2432 (1) a municipality that contains U.S. Highway 287 and
2533 State Highway 294 and is located in a county with a population of
2634 not less than 57,000 and not more than 59,000 on September 1, 2021;
2735 or
2836 (2) a municipality that:
2937 (A) has a municipal boundary located not more
3038 than 1.5 miles from an automobile racetrack with a seating capacity
3139 of more than 100,000;
3240 (B) has a population of more than 1,000 and less
3341 than 3,000; and
3442 (C) is located entirely within a county with a
3543 population of more than 650,000 that is adjacent to two counties,
3644 each of which has a population of more than 1.8 million.
3745 (b) Notwithstanding any other law, an area annexed to a
3846 municipality to which this section applies automatically assumes
3947 the wet or dry status of that municipality on annexation.
4048 SECTION 3. The change in law made by this Act applies to an
4149 area annexed by a municipality before, on, or after the effective
4250 date of this Act.
4351 SECTION 4. This Act takes effect September 1, 2021.
