| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 43.357, Parks and Wildlife Code, is |
|---|
| 10 | 10 | | amended by amending Subsections (a) and (b) to read as follows: |
|---|
| 11 | 11 | | (a) The holder of a valid deer breeder's permit may: |
|---|
| 12 | 12 | | (1) engage in the business of breeding breeder deer, |
|---|
| 13 | 13 | | including the propagation of breeder deer by cloning, in the |
|---|
| 14 | 14 | | immediate locality for which the permit was issued; and |
|---|
| 15 | 15 | | (2) sell, transfer to another person, or hold in |
|---|
| 16 | 16 | | captivity live breeder deer for the purpose of propagation or sale. |
|---|
| 17 | 17 | | (b) The commission may make regulations governing: |
|---|
| 18 | 18 | | (1) the possession of breeder deer held under the |
|---|
| 19 | 19 | | authority of this subchapter; |
|---|
| 20 | 20 | | (2) the recapture of lawfully possessed breeder deer |
|---|
| 21 | 21 | | that have escaped from the facility of a deer breeder; |
|---|
| 22 | 22 | | (3) permit applications and fees; |
|---|
| 23 | 23 | | (4) reporting requirements; |
|---|
| 24 | 24 | | (5) procedures and requirements for the purchase, |
|---|
| 25 | 25 | | transfer, sale, or shipment of breeder deer; |
|---|
| 26 | 26 | | (6) the endorsement of a deer breeder facility by a |
|---|
| 27 | 27 | | certified wildlife biologist; |
|---|
| 28 | 28 | | (7) the number of breeder deer that a deer breeder may |
|---|
| 29 | 29 | | possess; [and] |
|---|
| 30 | 30 | | (8) the dates for which a deer breeder permit is valid; |
|---|
| 31 | 31 | | and |
|---|
| 32 | 32 | | (9) the propagation of breeder deer by cloning. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2021. |
