4	11		AN ACT
5	12		relating to the use of the water infrastructure fund.
6	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	14		SECTION 1. Section 15.974(a), Water Code, is amended to
8	15		read as follows:
9	16		(a) The board may use the fund:
10	17		(1) to make loans to political subdivisions at or
11	18		below market interest rates for projects;
12	19		(2) to make grants, low-interest loans, or zero
13	20		interest loans to political subdivisions for projects to serve
14	21		areas outside metropolitan statistical areas in order to ensure
15	22		that the projects are implemented, or for projects to serve
16	23		economically distressed areas;
17	24		(3) to make loans at or below market interest rates for
18	25		planning and design costs, permitting costs, and other costs
19	26		associated with state or federal regulatory activities with respect
20	27		to a project;
21	28		(4) as a source of revenue or security for the payment
22	29		of principal and interest on bonds issued by the board if the
23	30		proceeds of the sale of the bonds will be deposited in the fund;
24	31		[and]
25	32		(5) to make transfers from the fund to the financial
26	33		assistance account of the Texas Water Development Fund II created
27	34		under Section 17.959 for the purposes described in Section 49-d-8,
28	35		Article III, Texas Constitution, other than for the purposes
29	36		described in Sections 17.957 and 17.958; and
30	37		(6) to pay the necessary and reasonable expenses of
31	38		the board in administering the fund.
32	39		SECTION 2. Section 17.9616(b), Water Code, is amended to
33	40		read as follows:
34	41		(b) The board shall use the water infrastructure fund as a
35	42		source of revenue to be deposited in accordance with this
36	43		subchapter for the payment of principal and interest on water
37	44		financial assistance bonds issued by the board, the proceeds of
38	45		which are to be deposited into the water infrastructure fund and to
39	46		be used to make payments under a bond enhancement agreement with
40	47		respect to principal or interest on the water financial assistance
41	48		bonds or for any other purpose authorized by Section 17.959(c).
42	49		SECTION 3. This Act takes effect September 1, 2021.
