411 AN ACT
512 relating to grants awarded to reimburse counties for the cost of
613 monitoring defendants and victims in criminal cases involving
714 family violence.
815 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
916 SECTION 1. Subchapter A, Chapter 772, Government Code, is
1017 amended by adding Section 772.0077 to read as follows:
1118 Sec. 772.0077. GRANT PROGRAM FOR MONITORING DEFENDANTS AND
1219 VICTIMS IN FAMILY VIOLENCE CASES. (a) In this section:
1320 (1) "Criminal justice division" means the criminal
1421 justice division established under Section 772.006.
1522 (2) "Family violence" has the meaning assigned by
1623 Section 71.004, Family Code.
1724 (b) The criminal justice division shall establish and
1825 administer a grant program to reimburse counties for all or part of
1926 the costs incurred by counties as a result of monitoring in cases
2027 involving family violence defendants and victims who participate in
2128 a global positioning monitoring system under Article 17.292 or
2229 17.49, Code of Criminal Procedure. A grant recipient may use funds
2330 from a grant awarded under the program only for monitoring
2431 conducted for the purpose of restoring a measure of security and
2532 safety for a victim of family violence.
2633 (c) The criminal justice division shall establish:
2734 (1) additional eligibility criteria for grant
2835 applicants;
2936 (2) grant application procedures;
3037 (3) guidelines relating to grant amounts;
3138 (4) procedures for evaluating grant applications; and
3239 (5) procedures for monitoring the use of a grant
3340 awarded under the program and ensuring compliance with any
3441 conditions of a grant.
3542 (d) The criminal justice division shall include in the
3643 biennial report required by Section 772.006(a)(9) a detailed
3744 reporting of the results and performance of the grant program
3845 administered under this section.
3946 (e) The criminal justice division may use any revenue
4047 available for purposes of this section.
4148 SECTION 2. This Act takes effect immediately if it receives
4249 a vote of two-thirds of all the members elected to each house, as
4350 provided by Section 39, Article III, Texas Constitution. If this
4451 Act does not receive the vote necessary for immediate effect, this
4552 Act takes effect September 1, 2021.
