8 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 16 | | SECTION 1. Subchapter A, Chapter 772, Government Code, is |
---|
10 | 17 | | amended by adding Section 772.0077 to read as follows: |
---|
11 | 18 | | Sec. 772.0077. GRANT PROGRAM FOR MONITORING DEFENDANTS AND |
---|
12 | 19 | | VICTIMS IN FAMILY VIOLENCE CASES. (a) In this section: |
---|
13 | 20 | | (1) "Criminal justice division" means the criminal |
---|
14 | 21 | | justice division established under Section 772.006. |
---|
15 | 22 | | (2) "Family violence" has the meaning assigned by |
---|
16 | 23 | | Section 71.004, Family Code. |
---|
17 | 24 | | (b) The criminal justice division shall establish and |
---|
18 | 25 | | administer a grant program to reimburse counties for all or part of |
---|
19 | 26 | | the costs incurred by counties as a result of monitoring in cases |
---|
20 | 27 | | involving family violence defendants and victims who participate in |
---|
21 | 28 | | a global positioning monitoring system under Article 17.292 or |
---|
22 | 29 | | 17.49, Code of Criminal Procedure. A grant recipient may use funds |
---|
23 | 30 | | from a grant awarded under the program only for monitoring |
---|
24 | 31 | | conducted for the purpose of restoring a measure of security and |
---|
25 | 32 | | safety for a victim of family violence. |
---|
26 | 33 | | (c) The criminal justice division shall establish: |
---|
27 | 34 | | (1) additional eligibility criteria for grant |
---|
28 | 35 | | applicants; |
---|
29 | 36 | | (2) grant application procedures; |
---|
30 | 37 | | (3) guidelines relating to grant amounts; |
---|
31 | 38 | | (4) procedures for evaluating grant applications; and |
---|
32 | 39 | | (5) procedures for monitoring the use of a grant |
---|
33 | 40 | | awarded under the program and ensuring compliance with any |
---|
34 | 41 | | conditions of a grant. |
---|
35 | 42 | | (d) The criminal justice division shall include in the |
---|
36 | 43 | | biennial report required by Section 772.006(a)(9) a detailed |
---|
37 | 44 | | reporting of the results and performance of the grant program |
---|
38 | 45 | | administered under this section. |
---|
39 | 46 | | (e) The criminal justice division may use any revenue |
---|
40 | 47 | | available for purposes of this section. |
---|
41 | 48 | | SECTION 2. This Act takes effect immediately if it receives |
---|
42 | 49 | | a vote of two-thirds of all the members elected to each house, as |
---|
43 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
44 | 51 | | Act does not receive the vote necessary for immediate effect, this |
---|
45 | 52 | | Act takes effect September 1, 2021. |
