55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on the cost of providing quality child care in
88 this state in comparison to family income.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 301, Labor Code, is
1111 amended by adding Section 301.0701 to read as follows:
1212 Sec. 301.0701. CHILD-CARE STUDY. (a) The commission shall
1313 conduct a study in this state regarding the cost, in comparison to
1414 family income, of providing child care that meets at least the
1515 minimum quality requirements for certification as a three-star
1616 rating provider under the Texas Rising Star Program. The study
1717 must:
1818 (1) examine statewide and for each local workforce
1919 development area the:
2020 (A) trends in the current costs and projections
2121 for future costs of providing quality child care;
2222 (B) costs of providing quality child care in
2323 comparison to family income based on federal poverty guidelines,
2424 state median household incomes, or other relevant income standards;
2525 (C) amount or estimated amount of governmental
2626 money available to support subsidized child care over the periods
2727 used for the data described in Paragraphs (A) and (B) and the number
2828 of children receiving subsidized child care; and
2929 (D) cost of providing quality child care in
3030 comparison to the reimbursement rate for subsidized child care and
3131 the market rate for providing that level of care; and
3232 (2) estimate the number of families eligible to
3333 receive subsidized child care.
3434 (b) In conducting the study under Subsection (a), the
3535 commission shall include the following expenses when calculating
3636 the cost of providing the quality child care described by that
3737 subsection:
3838 (1) the salary and benefits, including insurance, for
3939 the employees of the child-care facility;
4040 (2) the facility's operating costs, including any rent
4141 or mortgage, utility expenses, insurance, and building
4242 maintenance;
4343 (3) the costs for computer equipment, software, and
4444 other technology needed to operate the facility;
4545 (4) any costs incurred in obtaining certification
4646 under the Texas Rising Star Program, including any certification or
4747 assessment fees;
4848 (5) the license fees needed to operate the facility;
4949 and
5050 (6) any other expense the commission considers is
5151 necessary to provide the quality child care described by Subsection
5252 (a).
5353 (c) Not later than December 15, 2022, the commission shall
5454 report the results of the study conducted under Subsection (a) to
5555 the governor, the lieutenant governor, the speaker of the house of
5656 representatives, and each legislative standing committee with
5757 jurisdiction over child-care facilities.
5858 (d) Not later than December 15, 2024, the commission shall
5959 update the study results and provide the update to the governor, the
6060 lieutenant governor, the speaker of the house of representatives,
6161 and each legislative standing committee with jurisdiction over
6262 child-care facilities.
6363 (e) This section expires September 1, 2025.
6464 SECTION 2. This Act takes effect September 1, 2021.
