77 relating to the maternal mental health peer support pilot program
88 for perinatal mood and anxiety disorder.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 32, Health and Safety Code, is amended by
1111 adding Subchapter G to read as follows:
1212 SUBCHAPTER G. MATERNAL MENTAL HEALTH PEER SUPPORT PILOT PROGRAM
1313 Sec. 32.201. DEFINITIONS. In this subchapter:
1414 (1) "Peer support service" means a service provided by
1515 a peer support specialist to a person with a mental illness or
1616 substance use condition in accordance with commission rules
1717 regarding peer specialists.
1818 (2) "Perinatal mood and anxiety disorder" includes any
1919 of the following psychiatric illnesses, as defined by the American
2020 Psychiatric Association in the Diagnostic and Statistical Manual of
2121 Mental Disorders (DSM), that occur during pregnancy or within 12
2222 months postpartum:
2323 (A) bipolar disorder, including hypomanic,
2424 manic, depressive, and mixed types;
2525 (B) major depressive disorder, including
2626 single-episode and recurrent types;
2727 (C) generalized anxiety disorder;
2828 (D) obsessive-compulsive disorder;
2929 (E) paranoid or other psychotic disorder; and
3030 (F) post-traumatic stress disorder.
3131 (3) "Pilot program" means the maternal mental health
3232 peer support pilot program established under this subchapter.
3333 Sec. 32.202. ESTABLISHMENT OF PILOT PROGRAM. (a) The
3434 commission shall establish and operate the maternal mental health
3535 peer support pilot program to reduce the risk and manage the effects
3636 of perinatal mood and anxiety disorders in women through the
3737 delivery of peer support services at federally qualified health
3838 centers located in the geographic areas in which the pilot program
3939 operates.
4040 (b) The commission shall establish the pilot program in five
4141 counties in this state that:
4242 (1) either:
4343 (A) are within an area designated as a mental
4444 health professional shortage area; or
4545 (B) have high rates of maternal mortality and
4646 morbidity as determined by the commission in consultation with the
4747 Texas Maternal Mortality and Morbidity Review Committee; and
4848 (2) include at least one rural county and one county
4949 with a population of at least 500,000.
5050 Sec. 32.203. OPERATION OF PILOT PROGRAM. (a) In
5151 establishing the pilot program, the commission shall:
5252 (1) develop a strategy for federally qualified health
5353 centers participating in the pilot program and persons responsible
5454 for training to collaborate on the training, certification, and
5555 guidance of peer support specialists in accordance with existing
5656 state procedures and programs;
5757 (2) seek comments regarding best practices for the
5858 design and implementation of the pilot program from relevant
5959 interested persons, including federally qualified health centers,
6060 mental health care providers, local mental health authorities,
6161 certified peer support specialists and affiliated organizations,
6262 women's health care providers, and individuals who have personal
6363 experience with perinatal mood and anxiety disorders;
6464 (3) develop specialized training to:
6565 (A) identify and treat symptoms of perinatal mood
6666 and anxiety disorders; and
6767 (B) provide peer support services to pregnant
6868 women and new mothers;
6969 (4) develop a strategy for federally qualified health
7070 centers and peer support specialists participating in the pilot
7171 program to provide peer support services through any form of
7272 telephonic communication;
7373 (5) develop in collaboration with the federally
7474 qualified health centers participating in the pilot program a
7575 strategy to integrate the delivery of peer support services with
7676 the health care services provided by the centers to women during
7777 pregnancy and within one year of giving birth;
7878 (6) create for the federally qualified health centers
7979 participating in the pilot program a protocol for referring to peer
8080 support services women who are diagnosed as having or identified as
8181 being at risk of developing a perinatal mood and anxiety disorder;
8282 (7) ensure the services provided by peer support
8383 specialists under the pilot program are within the scope of a duty
8484 of care prescribed by commission rule for peer support specialists
8585 who provide similar services; and
8686 (8) develop a method for collecting data, including by
8787 consulting with the Texas Maternal Mortality and Morbidity Review
8888 Committee and other relevant entities regarding the data, on:
8989 (A) maternal health and mental health outcomes;
9090 and
9191 (B) substance use by women receiving peer support
9292 services through the pilot program.
9393 (b) A peer support specialist who provides peer support
9494 services through the pilot program at a federally qualified health
9595 center shall:
9696 (1) provide peer support services to women who:
9797 (A) based on the results of a postpartum
9898 depression screening or other screening tool, are diagnosed as
9999 having or identified as being at risk of developing a perinatal mood
100100 and anxiety disorder; and
101101 (B) are interested in receiving peer support
102102 services; and
103103 (2) through the use of the specialist's personal
104104 experience with perinatal mood and anxiety disorders:
105105 (A) provide guidance to the women;
106106 (B) if necessary, advocate for the women to
107107 receive mental health care services or other specialized health
108108 care services; and
109109 (C) provide the women with information on mental
110110 health care resources as necessary.
111111 Sec. 32.204. FUNDING. In addition to money appropriated by
112112 the legislature, the commission may accept gifts, grants, and
113113 donations from any source for establishing the pilot program and
114114 compensating peer support specialists under the pilot program.
115115 Sec. 32.205. REPORT. Not later than January 1, 2023, the
116116 commission shall prepare and submit to the governor, lieutenant
117117 governor, and legislature a written report that:
118118 (1) evaluates the success of the pilot program in
119119 reducing perinatal mood and anxiety disorders and substance use in
120120 women who received peer support services under the pilot program;
121121 and
122122 (2) recommends whether the pilot program should be
123123 continued, expanded, or terminated.
124124 Sec. 32.206. EXPIRATION. This subchapter expires September
125125 1, 2025.
126126 SECTION 2. (a) Not later than December 31, 2021, the
127127 executive commissioner of the Health and Human Services Commission
128128 shall adopt rules as necessary to establish the maternal mental
129129 health peer support pilot program as required by Subchapter G,
130130 Chapter 32, Health and Safety Code, as added by this Act.
131131 (b) Not later than June 30, 2022, the Health and Human
132132 Services Commission shall establish the maternal mental health peer
133133 support pilot program as required by Subchapter G, Chapter 32,
134134 Health and Safety Code, as added by this Act.
135135 SECTION 3. This Act takes effect September 1, 2021.
