66 AN ACT
77 relating to prohibited adverse employment action against certain
88 first responders based on mental illness.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 9, Health and Safety Code, is
1111 amended by adding Chapter 786 to read as follows:
1212 CHAPTER 786. PROHIBITED ADVERSE EMPLOYMENT ACTION AGAINST CERTAIN
1313 FIRST RESPONDERS
1414 Sec. 786.001. DEFINITIONS. In this chapter:
1515 (1) "First responder" means a public safety employee
1616 of a state agency or political subdivision of this state whose
1717 duties include responding rapidly to an emergency.
1818 (2) "Mental illness" has the meaning assigned by
1919 Section 571.003.
2020 Sec. 786.002. APPLICABILITY. This chapter applies only to
2121 a first responder who is:
2222 (1) a peace officer licensed under Chapter 1701,
2323 Occupations Code;
2424 (2) fire protection personnel as defined by Section
2525 419.021, Government Code; or
2626 (3) emergency medical services personnel licensed
2727 under Chapter 773.
2828 Sec. 786.003. DISCRIMINATION PROHIBITED. (a) Except as
2929 provided by Subsection (b), an employer of a first responder may not
3030 suspend, terminate, or take any other adverse employment action,
3131 including a demotion in rank or reduction of pay or benefits,
3232 against a first responder solely because the employer knows or
3333 believes that the first responder has a mental illness.
3434 (b) Notwithstanding Subsection (a), an employer of a first
3535 responder who knows or believes that the first responder has a
3636 mental illness may take an appropriate adverse employment action
3737 that is necessary to ensure public safety.
3838 Sec. 786.004. CLAIM OR DEFENSE BASED ON ADVERSE EMPLOYMENT
3939 ACTION; DAMAGES. (a) A person may assert a violation of this
4040 chapter as a claim against an employer, including a governmental
4141 entity, in a judicial or administrative proceeding or as a defense
4242 in a judicial or administrative proceeding.
4343 (b) An aggrieved person may seek:
4444 (1) compensatory damages;
4545 (2) reasonable attorney's fees and court costs; and
4646 (3) any other appropriate relief.
4747 Sec. 786.005. SOVEREIGN IMMUNITY WAIVED. Sovereign
4848 immunity to suit is waived and abolished to the extent of liability
4949 created by this chapter.
5050 SECTION 2. This Act applies only to a suspension,
5151 termination, or other adverse employment action taken by an
5252 employer against a first responder on or after the effective date of
5353 this Act. A suspension, termination, or other adverse employment
5454 action that is taken by an employer against a first responder before
5555 the effective date of this Act is governed by the law in effect on
5656 the date the employment action is taken, and the former law is
5757 continued in effect for that purpose.
5858 SECTION 3. This Act takes effect September 1, 2021.
