4	12		AN ACT
5	13		relating to certain statutes and governmental actions that relate
6	14		to the federal census.
7	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	16		SECTION 1. Section 2058.001(b), Government Code, is amended
9	17		to read as follows:
10	18		(b) A governmental entity shall recognize and act on a
11	19		published report or count relating to a federal decennial census
12	20		and released by the director of the Bureau of the Census of the
13	21		United States Department of Commerce on the later of:
14	22		(1) [on] September 1 of the year after the calendar
15	23		year during which the census was taken [if the report or count is
16	24		published on or before that date]; or
17	25		(2) [on] the first day of the first calendar month
18	26		occurring after the 150th day after the date of the [its]
19	27		publication of the report or count [if the report or count is
20	28		published after September 1 of the year after the calendar year
21	29		during which the census was taken].
22	30		SECTION 2. Section 2058.002, Government Code, is amended by
23	31		adding Subsections (c), (d), and (e) to read as follows:
24	32		(c) Nothing in this chapter prohibits the legislature from
25	33		acting on published reports and counts described by Section
26	34		2058.001(b) and relating to the 2020 federal decennial census,
27	35		regardless of the date the reports or counts are published.
28	36		(d) Notwithstanding any other law, the commissioners court
29	37		of a county may act on published reports or counts described by
30	38		Section 2058.001(b) and relating to the 2020 federal decennial
31	39		census, and any information provided by the state relating to
32	40		redistricting based on those reports or counts, in carrying out the
33	41		commissioners court's duties under Chapter 42, Election Code, with
34	42		respect to establishing or changing election precincts, regardless
35	43		of the date the reports or counts are published or the information
36	44		is provided or any required period for those duties as provided by
37	45		law.
38	46		(e) This subsection and Subsections (c) and (d) expire
39	47		September 1, 2023.
40	48		SECTION 3. Chapter 2058, Government Code, is amended by
41	49		adding Section 2058.0021 to read as follows:
42	50		Sec. 2058.0021. APPLICABILITY OF 2010 FEDERAL CENSUS;
43	51		TEMPORARY PROVISION. (a) Except as expressly provided by other law
44	52		and notwithstanding the definition of "population" in Sections
45	53		311.005 and 312.011, a statute that applies to a political
46	54		subdivision having a certain population according to the most
47	55		recent federal census:
48	56		(1) continues to apply to the same political
49	57		subdivisions to which the statute applied under the 2010 federal
50	58		census, regardless of whether the political subdivisions continue
51	59		to have the population prescribed by the statute according to the
52	60		2020 federal census; and
53	61		(2) does not apply to a political subdivision to which
54	62		the statute did not apply under the 2010 federal census, regardless
55	63		of whether the political subdivision has the population prescribed
56	64		by the statute according to the 2020 federal census.
57	65		(b) This section expires September 1, 2023.
58	66		SECTION 4. This Act takes effect immediately if it receives
59	67		a vote of two-thirds of all the members elected to each house, as
60	68		provided by Section 39, Article III, Texas Constitution. If this
61	69		Act does not receive the vote necessary for immediate effect, this
62	70		Act takes effect September 1, 2021.
