55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to persons authorized to conduct a marriage ceremony.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9- SECTION 1. Sections 2.202(a), (b), and (b-1), Family Code,
10- are amended to read as follows:

1111 (a) The following persons are authorized to conduct a

13- (1) [a licensed or ordained Christian minister or

20- court of criminal appeals, justice of the courts of appeals, judge
21- of the district, county, and probate courts, judge of the county
22- courts at law, judge of the courts of domestic relations, judge of
23- the juvenile courts, retired justice or judge of those courts,
24- justice of the peace, retired justice of the peace, judge of a
25- municipal court, retired judge of a municipal court, associate
26- judge of a statutory probate court, retired associate judge of a
27- statutory probate court, associate judge of a county court at law,
28- retired associate judge of a county court at law, or judge or
29- magistrate of a federal court of this state; and
30- (3) [(5)] a retired judge or magistrate of a federal
31- court of this state.
32- (b) For the purposes of Subsection (a)(2) [(a)(4)], a
33- retired judge or justice is a former judge or justice who is vested
34- in the Judicial Retirement System of Texas Plan One or the Judicial
35- Retirement System of Texas Plan Two or who has an aggregate of at
36- least 12 years of service as judge or justice of any type listed in
37- Subsection (a)(2) [(a)(4)].
38- (b-1) For the purposes of Subsection (a)(3) [(a)(5)], a
39- retired judge or magistrate is a former judge or magistrate of a
40- federal court of this state who is fully vested in the Federal
41- Employees Retirement System under 28 U.S.C. Section 371 or 377.
15+ (2) a Jewish rabbi;
16+ (2-a) a Muslim imam;
17+ (3) a person who is an officer of a religious
18+ organization and who is authorized by the organization to conduct a
19+ marriage ceremony;
20+ (4) a justice of the supreme court, judge of the court
21+ of criminal appeals, justice of the courts of appeals, judge of the
22+ district, county, and probate courts, judge of the county courts at
23+ law, judge of the courts of domestic relations, judge of the
24+ juvenile courts, retired justice or judge of those courts, justice
25+ of the peace, retired justice of the peace, judge of a municipal
26+ court, retired judge of a municipal court, associate judge of a
27+ statutory probate court, retired associate judge of a statutory
28+ probate court, associate judge of a county court at law, retired
29+ associate judge of a county court at law, or judge or magistrate of
30+ a federal court of this state; and
31+ (5) a retired judge or magistrate of a federal court of
32+ this state.
4233 SECTION 2. This Act takes effect September 1, 2021.
