8 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 17 | | SECTION 1. The heading to Chapter 180, Local Government |
---|
10 | 18 | | Code, is amended to read as follows: |
---|
11 | 19 | | CHAPTER 180. MISCELLANEOUS PROVISIONS AFFECTING OFFICERS AND |
---|
12 | 20 | | EMPLOYEES OF MORE THAN ONE TYPE OF [MUNICIPALITIES, COUNTIES, AND |
---|
13 | 21 | | CERTAIN OTHER] LOCAL GOVERNMENT [GOVERNMENTS] |
---|
14 | 22 | | SECTION 2. Chapter 180, Local Government Code, is amended |
---|
15 | 23 | | by adding Section 180.008 to read as follows: |
---|
16 | 24 | | Sec. 180.008. PAID QUARANTINE LEAVE FOR FIRE FIGHTERS, |
---|
17 | 25 | | PEACE OFFICERS, DETENTION OFFICERS, AND EMERGENCY MEDICAL |
---|
18 | 26 | | TECHNICIANS. (a) In this section: |
---|
19 | 27 | | (1) "Detention officer" means an individual appointed |
---|
20 | 28 | | or employed by a political subdivision as a county jailer or other |
---|
21 | 29 | | individual responsible for the care and custody of individuals |
---|
22 | 30 | | incarcerated in a county or municipal jail. |
---|
23 | 31 | | (2) "Emergency medical technician" means an |
---|
24 | 32 | | individual who is: |
---|
25 | 33 | | (A) certified as an emergency medical technician |
---|
26 | 34 | | under Chapter 773, Health and Safety Code; and |
---|
27 | 35 | | (B) employed by a political subdivision. |
---|
28 | 36 | | (3) "Fire fighter" means a paid employee of a |
---|
29 | 37 | | municipal fire department or emergency services district who: |
---|
30 | 38 | | (A) holds a position that requires substantial |
---|
31 | 39 | | knowledge of fire fighting; |
---|
32 | 40 | | (B) has met the requirements for certification by |
---|
33 | 41 | | the Texas Commission on Fire Protection under Chapter 419, |
---|
34 | 42 | | Government Code; and |
---|
35 | 43 | | (C) performs a function listed in Section |
---|
36 | 44 | | 143.003(4)(A). |
---|
37 | 45 | | (4) "Health authority" has the meaning assigned by |
---|
38 | 46 | | Section 121.021, Health and Safety Code. |
---|
39 | 47 | | (5) "Peace officer" means an individual described by |
---|
40 | 48 | | Article 2.12, Code of Criminal Procedure, who is elected for, |
---|
41 | 49 | | employed by, or appointed by a political subdivision. |
---|
42 | 50 | | (b) The governing body of a political subdivision shall |
---|
43 | 51 | | develop and implement a paid quarantine leave policy for fire |
---|
44 | 52 | | fighters, peace officers, detention officers, and emergency |
---|
45 | 53 | | medical technicians who are employed by, appointed by, or elected |
---|
46 | 54 | | for the political subdivision and ordered to quarantine or isolate |
---|
47 | 55 | | due to a possible or known exposure to a communicable disease while |
---|
48 | 56 | | on duty. |
---|
49 | 57 | | (c) A paid quarantine leave policy must: |
---|
50 | 58 | | (1) provide that a fire fighter, peace officer, |
---|
51 | 59 | | detention officer, or emergency medical technician on paid |
---|
52 | 60 | | quarantine leave receive: |
---|
53 | 61 | | (A) all employment benefits and compensation, |
---|
54 | 62 | | including leave accrual, pension benefits, and health benefit plan |
---|
55 | 63 | | benefits for the duration of the leave; and |
---|
56 | 64 | | (B) reimbursement for reasonable costs related |
---|
57 | 65 | | to the quarantine, including lodging, medical, and transportation; |
---|
58 | 66 | | and |
---|
59 | 67 | | (2) require that the leave be ordered by the person's |
---|
60 | 68 | | supervisor or the political subdivision's health authority. |
---|
61 | 69 | | (d) A political subdivision may not reduce a fire fighter's, |
---|
62 | 70 | | peace officer's, detention officer's, or emergency medical |
---|
63 | 71 | | technician's sick leave balance, vacation leave balance, holiday |
---|
64 | 72 | | leave balance, or other paid leave balance in connection with paid |
---|
65 | 73 | | quarantine leave taken in accordance with a policy adopted under |
---|
66 | 74 | | this section. |
---|
67 | 75 | | SECTION 3. This Act takes effect immediately if it receives |
---|
68 | 76 | | a vote of two-thirds of all the members elected to each house, as |
---|
69 | 77 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
70 | 78 | | Act does not receive the vote necessary for immediate effect, this |
---|
71 | 79 | | Act takes effect September 1, 2021. |
