| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 143, Election Code, is amended by adding |
|---|
| 11 | 11 | | Section 143.0011 to read as follows: |
|---|
| 12 | 12 | | Sec. 143.0011. PARTISAN CANDIDACY REQUIRED. (a) A |
|---|
| 13 | 13 | | candidate must declare a party affiliation to run for a city office. |
|---|
| 14 | 14 | | (b) A candidate's party affiliation must appear on the |
|---|
| 15 | 15 | | ballot next to the candidate's name. |
|---|
| 16 | 16 | | SECTION 2. The heading to Section 143.003, Election Code, |
|---|
| 17 | 17 | | is amended to read as follows: |
|---|
| 18 | 18 | | Sec. 143.003. PARTISAN NOMINATION [CANDIDACY] FOR |
|---|
| 19 | 19 | | HOME-RULE CITY OFFICE AUTHORIZED. |

| 20 | 20 | | SECTION 3. Section 143.004, Election Code, is amended to |

| 21 | 21 | | read as follows: |

| 22 | 22 | | Sec. 143.004. APPLICATION REQUIRED. (a) Subject to Section |

| 23 | 23 | | 143.005, to be entitled to a place on the ballot, a candidate must |
|---|
| 24 | 24 | | make an application for a place on the ballot. |

| 25 | 25 | | (b) An application must state the political party with which |
|---|
| 26 | 26 | | the candidate is aligned or, if the candidate is not aligned with a |
|---|
| 27 | 27 | | party, state that fact. |

| 28 | 28 | | SECTION 4. Section 143.002, Election Code, is repealed. |
|---|
| 29 | 29 | | SECTION 5. This Act takes effect September 1, 2021. |
