55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a requirement that candidates for municipal elective
88 office declare a party affiliation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 143, Election Code, is amended by adding
1111 Section 143.0011 to read as follows:
1212 Sec. 143.0011. PARTISAN CANDIDACY REQUIRED. (a) A
1313 candidate must declare a party affiliation to run for a city office.
1414 (b) A candidate's party affiliation must appear on the
1515 ballot next to the candidate's name.
1616 SECTION 2. The heading to Section 143.003, Election Code,
1717 is amended to read as follows:
1818 Sec. 143.003. PARTISAN NOMINATION [CANDIDACY] FOR
1919 HOME-RULE CITY OFFICE AUTHORIZED.
2020 SECTION 3. Section 143.004, Election Code, is amended to
2121 read as follows:
2222 Sec. 143.004. APPLICATION REQUIRED. (a) Subject to Section
2323 143.005, to be entitled to a place on the ballot, a candidate must
2424 make an application for a place on the ballot.
2525 (b) An application must state the political party with which
2626 the candidate is aligned or, if the candidate is not aligned with a
2727 party, state that fact.
2828 SECTION 4. Section 143.002, Election Code, is repealed.
2929 SECTION 5. This Act takes effect September 1, 2021.
