7 | 14 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 15 | SECTION 1. Subchapter D, Chapter 91, Natural Resources | |
9 | 16 | Code, is amended by adding Section 91.1017 to read as follows: | |
10 | 17 | Sec. 91.1017. LOCATION OF CERTAIN PITS. The commission by | |
11 | 18 | rule shall establish standards governing permissible locations for | |
12 | 19 | pits used by commercial oil and gas disposal facilities. The rules | |
13 | 20 | must include a history of flooding in the 10 years preceding the | |
14 | 21 | construction of the pit as a factor in determining whether a | |
15 | 22 | proposed location of a pit is permissible. | |
16 | 23 | SECTION 2. This Act takes effect September 1, 2021. | |
