8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 15 | | SECTION 1. Section 45.102, Family Code, is amended by |
---|
10 | 16 | | adding Subsection (c) to read as follows: |
---|
11 | 17 | | (c) A petitioner is not required to provide the street |
---|
12 | 18 | | address of the petitioner's place of residence or the petitioner's |
---|
13 | 19 | | reason for the requested change of name as otherwise required by |
---|
14 | 20 | | Subsection (a) if the petitioner provides a copy of an |
---|
15 | 21 | | authorization card certifying in accordance with Article 58.059, |
---|
16 | 22 | | Code of Criminal Procedure, that the petitioner is a participant in |
---|
17 | 23 | | the address confidentiality program administered by the attorney |
---|
18 | 24 | | general under Subchapter B, Chapter 58, Code of Criminal Procedure. |
---|
19 | 25 | | SECTION 2. Section 45.103, Family Code, is amended by |
---|
20 | 26 | | adding Subsections (a-1) and (c-1) to read as follows: |
---|
21 | 27 | | (a-1) For purposes of Subsection (a), it is presumed that a |
---|
22 | 28 | | change of name is in the interest or to the benefit of the |
---|
23 | 29 | | petitioner and in the interest of the public if the petitioner |
---|
24 | 30 | | provides a copy of an authorization card certifying in accordance |
---|
25 | 31 | | with Article 58.059, Code of Criminal Procedure, that the |
---|
26 | 32 | | petitioner is a participant in the address confidentiality program |
---|
27 | 33 | | administered by the attorney general under Subchapter B, Chapter |
---|
28 | 34 | | 58, Code of Criminal Procedure. |
---|
29 | 35 | | (c-1) An order issued under this section to change the name |
---|
30 | 36 | | of a petitioner described by Subsection (a-1) is confidential and |
---|
31 | 37 | | may not be released by the court to any person, regardless of |
---|
32 | 38 | | whether the petitioner continues to participate in the address |
---|
33 | 39 | | confidentiality program following the change of name under this |
---|
34 | 40 | | subchapter. |
---|
35 | 41 | | SECTION 3. The change in law made by this Act applies only |
---|
36 | 42 | | to a petition for a change of name that is submitted on or after the |
---|
37 | 43 | | effective date of this Act. |
---|
38 | 44 | | SECTION 4. This Act takes effect September 1, 2021. |
