| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |

| 11 | 11 | | amended by adding Section 38.039 to read as follows: |
|---|
| 12 | 12 | | Sec. 38.039. INCLUSIVE AND ACCESSIBLE PLAYGROUNDS. From |
|---|
| 13 | 13 | | funds appropriated for the purpose or any other available funds, |
|---|
| 14 | 14 | | the commissioner shall distribute funds to each school district to |
|---|
| 15 | 15 | | provide at least one playground in the district that is inclusive |
|---|
| 16 | 16 | | and accessible for students with disabilities. |
|---|
| 17 | 17 | | SECTION 2. This Act applies beginning with the 2021-2022 |
|---|
| 18 | 18 | | school year. |
|---|
| 19 | 19 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2021. |
