45 A BILL TO BE ENTITLED
56 AN ACT
67 relating to the waiver of requirements for removing a person's
78 license from inactive status during a state of disaster.
89 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
910 SECTION 1. Section 301.261, Occupations Code, is amended by
1011 adding Subsection (d-1) to read as follows:
1112 (d-1) Notwithstanding Subsection (d) and as necessary to
1213 mitigate a nursing workforce shortage caused by a state of
1314 disaster, the board shall waive a requirement that a person pay a
14- reactivation fee or complete any required continuing education to
15- remove the person's license from inactive status if the license has
16- been on inactive status for less than four years.

1718 SECTION 2. This Act takes effect immediately if it receives
1819 a vote of two-thirds of all the members elected to each house, as
1920 provided by Section 39, Article III, Texas Constitution. If this
2021 Act does not receive the vote necessary for immediate effect, this
2122 Act takes effect September 1, 2021.
