| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39.151, Utilities Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (c-1) to read as follows: |
|---|
| 12 | 12 | | (c-1) Notwithstanding any other law, the commission shall |
|---|
| 13 | 13 | | decertify an independent organization that was certified under this |
|---|
| 14 | 14 | | section for the ERCOT power region before September 1, 2021, and |
|---|
| 15 | 15 | | certify the Railroad Commission of Texas as the successor |
|---|
| 16 | 16 | | organization for that power region. A reference in law to an |
|---|
| 17 | 17 | | independent organization certified under this section for the ERCOT |
|---|
| 18 | 18 | | power region means the Railroad Commission of Texas. A provision of |
|---|
| 19 | 19 | | this chapter that grants the commission oversight over the budget |
|---|
| 20 | 20 | | of an independent organization does not apply to the Railroad |
|---|
| 21 | 21 | | Commission of Texas. Subsections (d-1), (d-2), (d-3), (d-4), (e), |
|---|
| 22 | 22 | | (e-1), (g), (g-1), (h), and (i) do not apply to the Railroad |
|---|
| 23 | 23 | | Commission of Texas. Sections 39.1511 and 39.1512 do not apply to |
|---|
| 24 | 24 | | the Railroad Commission of Texas. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2021. |
