A BILL TO BE ENTITLED
AN ACT
relating to certifying the Railroad Commission of Texas as the
independent organization for the ERCOT power region.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 39.151, Utilities Code, is amended by
adding Subsection (c-1) to read as follows:
(c-1) Notwithstanding any other law, the commission shall
decertify an independent organization that was certified under this
section for the ERCOT power region before September 1, 2021, and
certify the Railroad Commission of Texas as the successor
organization for that power region. A reference in law to an
independent organization certified under this section for the ERCOT
power region means the Railroad Commission of Texas. A provision of
this chapter that grants the commission oversight over the budget
of an independent organization does not apply to the Railroad
Commission of Texas. Subsections (d-1), (d-2), (d-3), (d-4), (e),
(e-1), (g), (g-1), (h), and (i) do not apply to the Railroad
Commission of Texas. Sections 39.1511 and 39.1512 do not apply to
the Railroad Commission of Texas.
SECTION 2. This Act takes effect September 1, 2021.
