55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the exception to disclosure under the public
88 information law of certain personal information contained in a
99 citation issued for a violation of a state traffic law or local
1010 traffic ordinance.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1313 amended by adding Section 552.1082 to read as follows:
1414 Sec. 552.1082. EXCEPTION: CERTAIN PERSONAL INFORMATION
1515 FROM TRAFFIC VIOLATION RECORDS. (a) Except as provided by
1616 Subsection (b), information contained in a citation issued for a
1717 violation of a state traffic law or local traffic ordinance is
1818 excepted from the requirements of Section 552.021 if the
1919 information is the home address or personal telephone number of the
2020 person who is the subject of a citation.
2121 (b) Information described by Subsection (a) shall be made
2222 available on the request of:
2323 (1) a radio or television station that holds a license
2424 issued by the Federal Communications Commission; or
2525 (2) a newspaper that is:
2626 (A) a free newspaper of general circulation or
2727 qualified under Section 2051.044 to publish legal notices;
2828 (B) published at least once a week; and
2929 (C) available and of interest to the general
3030 public in connection with the dissemination of news.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2021.
