95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to eligibility for a loan under the disaster recovery loan
128 program.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Section 418.062, Government Code, is amended to
1511 read as follows:
1612 Sec. 418.062. ELIGIBILITY FOR LOAN. (a) A political
1713 subdivision may apply to the division for a loan under this
1814 subchapter if:
1915 (1) the political subdivision:
2016 (A) is located wholly or partly in an area
2117 declared to be a disaster area by the governor or the president of
2218 the United States; and
2319 (B) before applying to the division for a loan
2420 under this subchapter, submits[:
2521 [(i) has submitted] to the division[,
2622 within 15 days of the date of its adoption by the governing body of
2723 the political subdivision,] the political subdivision's operating
2824 budget for the most recent fiscal year; [and
2925 [(ii) has submitted an application for a
3026 loan from the Federal Emergency Management Agency's community
3127 disaster loan program;]
3228 (2) an assessment of damages due to the disaster for
3329 which the declaration was made has been conducted in the political
3430 subdivision; and
3531 (3) the division[, in consultation with the Federal
3632 Emergency Management Agency,] determines that the political
3733 subdivision's estimated cost to appropriately respond to [rebuild
3834 the political subdivision's infrastructure damaged in] the
3935 disaster is greater than 50 percent of the political subdivision's
4036 total revenue for the current year as shown in the most recent
4137 operating budget of the political subdivision submitted to the
4238 division under this section.
4339 (b) The division may consult with the Federal Emergency
4440 Management Agency in making the determination required under
4541 Subsection (a)(3).
4642 SECTION 2. The change in law made by this Act applies only
4743 to a loan the application for which is filed on or after the
4844 effective date of this Act. A loan the application for which is
4945 filed before that date is governed by the law in effect on the date
5046 on which the application was filed, and the former law is continued
5147 in effect for that purpose.
5248 SECTION 3. This Act takes effect immediately if it receives
5349 a vote of two-thirds of all the members elected to each house, as
5450 provided by Section 39, Article III, Texas Constitution. If this
5551 Act does not receive the vote necessary for immediate effect, this
5652 Act takes effect September 1, 2021.
