105 AN ACT
116 relating to the requirement that individuals joining the Texas
127 National Guard sign a notice regarding active combat duty.
138 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
149 SECTION 1. The heading to Section 437.007, Government Code,
1510 is amended to read as follows:
1611 Sec. 437.007. ENLISTMENT AND APPOINTMENT; NOTICE.
1712 SECTION 2. Section 437.007, Government Code, is amended by
1813 adding Subsection (c) to read as follows:
1914 (c) Before an individual may enlist in or accept an
2015 appointment with the Texas National Guard, the individual shall
2116 sign the following written notice that is printed in 24-point
2217 bold-faced type:
2318 BY JOINING THE TEXAS NATIONAL GUARD I UNDERSTAND THAT I MAY BE
2419 CALLED TO ACTIVE DUTY BY THE PRESIDENT TO SERVE ON ACTIVE COMBAT
2520 DUTY IN A WAR DECLARED BY AN ACT OF CONGRESS OR IN ANOTHER ARMED
2621 CONFLICT AS ORDERED BY THE PRESIDENT. ACTIVE COMBAT DUTY MAY
2722 INCLUDE:
2823 (1) PARTICIPATING IN AN ARMED CONFLICT;
2924 (2) PERFORMING A HAZARDOUS SERVICE;
3025 (3) PERFORMING A DUTY UNDER CONDITIONS SIMULATING WAR;
3126 AND
3227 (4) PERFORMING A DUTY THROUGH AN INSTRUMENTALITY OF
3328 WAR.
3429 SECTION 3. This Act takes effect September 1, 2021.
