| 9 | 17 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 18 | | SECTION 1. Section 361.133, Health and Safety Code, is |
|---|
| 11 | 19 | | amended by adding Subsection (c-1) to read as follows: |
|---|
| 12 | 20 | | (c-1) Notwithstanding Subsection (c), money in the account |
|---|
| 13 | 21 | | attributable to fees imposed under Section 361.138 may be used for |
|---|
| 14 | 22 | | reimbursement of environmental remediation at the site of a former |
|---|
| 15 | 23 | | battery recycling facility located in the municipal boundaries of a |
|---|
| 16 | 24 | | municipality with a population of more than 115,000 and less than |
|---|
| 17 | 25 | | 250,000 if a community development corporation serving the |
|---|
| 18 | 26 | | municipality is issued an industrial hazardous waste permit by the |
|---|
| 19 | 27 | | commission for the site and is paying or has paid for part of the |
|---|
| 20 | 28 | | costs of the environmental remediation of the site pursuant to the |
|---|
| 21 | 29 | | permit. This subsection expires September 1, 2027. |
|---|
| 22 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 34 | | Act takes effect September 1, 2021. |
