55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to eligibility for a service retirement annuity of members
88 of the elected class of the Employees Retirement System of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 814.102, Government Code, is amended to
1111 read as follows:
1212 Sec. 814.102. ELIGIBILITY OF ELECTED MEMBERS FOR SERVICE
1313 RETIREMENT. Except as provided by rule adopted under Section
1414 813.304(d) or Section 803.202(a)(2), a member who has service
1515 credit in the elected class of membership, is eligible to retire and
1616 receive a service retirement annuity if the member:
1717 (1) is at least 60 years old and has:
1818 (A) except as provided by Paragraph (B) of this
1919 subdivision, eight [8] years of service credit in that class; or
2020 (B) six years of service credit in that class, if
2121 the member:
2222 (i) has at least two years of military
2323 service; and
2424 (ii) if applicable, was released from
2525 military duty under conditions not dishonorable; or
2626 (2) is at least 50 years old and has:
2727 (A) except as provided by Paragraph (B) of this
2828 subdivision, 12 years of service credit in that class; or
2929 (B) 10 years of service credit in that class, if
3030 the member:
3131 (i) has at least two years of military
3232 service; and
3333 (ii) if applicable, was released from
3434 military duty under conditions not dishonorable.
3535 SECTION 2. This Act takes effect September 1, 2021.
