| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 814.102, Government Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 814.102. ELIGIBILITY OF ELECTED MEMBERS FOR SERVICE |
|---|
| 13 | 13 | | RETIREMENT. Except as provided by rule adopted under Section |
|---|
| 14 | 14 | | 813.304(d) or Section 803.202(a)(2), a member who has service |
|---|
| 15 | 15 | | credit in the elected class of membership, is eligible to retire and |
|---|
| 16 | 16 | | receive a service retirement annuity if the member: |
|---|
| 17 | 17 | | (1) is at least 60 years old and has: |
|---|
| 18 | 18 | | (A) except as provided by Paragraph (B) of this |
|---|
| 19 | 19 | | subdivision, eight [8] years of service credit in that class; or |
|---|
| 20 | 20 | | (B) six years of service credit in that class, if |
|---|
| 21 | 21 | | the member: |
|---|
| 22 | 22 | | (i) has at least two years of military |
|---|
| 23 | 23 | | service; and |
|---|
| 24 | 24 | | (ii) if applicable, was released from |
|---|
| 25 | 25 | | military duty under conditions not dishonorable; or |
|---|
| 26 | 26 | | (2) is at least 50 years old and has: |
|---|
| 27 | 27 | | (A) except as provided by Paragraph (B) of this |
|---|
| 28 | 28 | | subdivision, 12 years of service credit in that class; or |
|---|
| 29 | 29 | | (B) 10 years of service credit in that class, if |
|---|
| 30 | 30 | | the member: |
|---|
| 31 | 31 | | (i) has at least two years of military |
|---|
| 32 | 32 | | service; and |
|---|
| 33 | 33 | | (ii) if applicable, was released from |
|---|
| 34 | 34 | | military duty under conditions not dishonorable. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2021. |
