 A BILL TO BE ENTITLED
 AN ACT
 relating to eligibility for a service retirement annuity of members
 of the elected class of the Employees Retirement System of Texas.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 814.102, Government Code, is amended to
 read as follows:
 Sec. 814.102.  ELIGIBILITY OF ELECTED MEMBERS FOR SERVICE
 RETIREMENT. Except as provided by rule adopted under Section
 813.304(d) or Section 803.202(a)(2), a member who has service
 credit in the elected class of membership, is eligible to retire and
 receive a service retirement annuity if the member:
 (1)  is at least 60 years old and has:
 (A)  except as provided by Paragraph (B) of this
 subdivision, eight [8] years of service credit in that class; or
 (B)  six years of service credit in that class, if
 the member:
 (i)  has at least two years of military
 service; and
 (ii)  if applicable, was released from
 military duty under conditions not dishonorable; or
 (2)  is at least 50 years old and has:
 (A)  except as provided by Paragraph (B) of this
 subdivision, 12 years of service credit in that class; or
 (B)  10 years of service credit in that class, if
 the member:
 (i)  has at least two years of military
 service; and
 (ii)  if applicable, was released from
 military duty under conditions not dishonorable.
 SECTION 2.  This Act takes effect September 1, 2021.
