| 13 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 10 | | SECTION 1. Subchapter K, Chapter 659, Government Code, is |
|---|
| 15 | 11 | | amended by adding Section 659.2532 to read as follows: |
|---|
| 16 | 12 | | Sec. 659.2532. TRANSFER WITHIN AGENCY BETWEEN CLASSIFIED |
|---|
| 17 | 13 | | POSITIONS WITH SAME POSITION TITLE WHEN EMPLOYEE IS COMPETITIVELY |

| 18 | 14 | | SELECTED. (a) In this section, "classified position" means a |
|---|
| 19 | 15 | | position classified under the state's position classification |
|---|
| 20 | 16 | | plan. |
|---|
| 21 | 17 | | (b) A state employee's annual salary rate immediately after |
|---|
| 22 | 18 | | a transfer may be set at any rate in the appropriate salary group if |
|---|
| 23 | 19 | | the employee: |
|---|
| 24 | 20 | | (1) transfers within a state agency between two |
|---|
| 25 | 21 | | classified positions that: |
|---|
| 26 | 22 | | (A) are allocated to the same salary group; and |
|---|
| 27 | 23 | | (B) have the same position title as listed in the |
|---|
| 28 | 24 | | General Appropriations Act; |
|---|
| 29 | 25 | | (2) transfers to a position for which the employment |
|---|
| 30 | 26 | | opening is publicly listed in accordance with Chapter 656; |
|---|
| 31 | 27 | | (3) voluntarily applies for the position to which the |
|---|
| 32 | 28 | | employee transfers; and |
|---|
| 33 | 29 | | (4) agrees to accept the position to which the |
|---|
| 34 | 30 | | employee transfers at the publicly listed salary. |
|---|
| 35 | 31 | | SECTION 2. Section 659.2532, Government Code, as added by |
|---|
| 36 | 32 | | this Act, applies only to a transfer of position that takes effect |
|---|
| 37 | 33 | | on or after September 1, 2021. A transfer of position that takes |
|---|
| 38 | 34 | | effect before September 1, 2021, is governed by the law in effect on |
|---|
| 39 | 35 | | the effective date of the transfer, and the former law is continued |
|---|
| 40 | 36 | | in effect for that purpose. |
|---|
| 41 | 37 | | SECTION 3. This Act takes effect September 1, 2021. |
