410 AN ACT
511 relating to the enforcement of commercial motor vehicle safety
612 standards in certain municipalities.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 644.101(b), Transportation Code, as
915 reenacted and amended by Chapters 102 (S.B. 636), 163 (H.B. 695),
1016 169 (H.B. 917), and 467 (H.B. 4170), Acts of the 86th Legislature,
1117 Regular Session, 2019, is reenacted and amended to read as follows:
1218 (b) A police officer of any of the following municipalities
1319 is eligible to apply for certification under this section:
1420 (1) a municipality with a population of 50,000 or
1521 more;
1622 (2) a municipality with a population of 25,000 or more
1723 any part of which is located in a county with a population of
1824 500,000 or more;
1925 (3) a municipality with a population of less than
2026 25,000:
2127 (A) any part of which is located in a county with
2228 a population of 3.3 million; and
2329 (B) that contains or is adjacent to an
2430 international port;
2531 (4) a municipality with a population of at least
2632 34,000 that is located in a county that borders two or more states;
2733 (5) a municipality any part of which is located in a
2834 county bordering the United Mexican States;
2935 (6) a municipality with a population of less than
3036 5,000 that is located:
3137 (A) adjacent to a bay connected to the Gulf of
3238 Mexico; and
3339 (B) in a county adjacent to a county with a
3440 population greater than 3.3 million;
3541 (7) a municipality that is located:
3642 (A) within 25 miles of an international port; and
3743 (B) in a county that does not contain a highway
3844 that is part of the national system of interstate and defense
3945 highways and is adjacent to a county with a population greater than
4046 3.3 million;
4147 (8) a municipality with a population of less than
4248 8,500 that:
4349 (A) is the county seat; and
4450 (B) contains a highway that is part of the
4551 national system of interstate and defense highways;
4652 (9) a municipality located in a county with a
4753 population between 60,000 and 66,000 adjacent to a bay connected to
4854 the Gulf of Mexico;
4955 (10) a municipality with a population of more than
5056 40,000 and less than 50,000 that is located in a county with a
5157 population of more than 285,000 and less than 300,000 that borders
5258 the Gulf of Mexico;
5359 (11) a municipality with a population between 32,000
5460 [18,000] and 50,000 [18,500] that is located entirely in a county
5561 that:
5662 (A) has a population of less than 250,000
5763 [200,000];
5864 (B) is adjacent to two counties that each have a
5965 population of more than 1.2 million; and
6066 (C) contains two highways that are part of the
6167 national system of interstate and defense highways; [or]
6268 (12) a municipality with a population of more than
6369 3,000 and less than 10,000 that:
6470 (A) contains a highway that is part of the
6571 national system of interstate and defense highways; and
6672 (B) is located in a county with a population
6773 between 150,000 and 155,000; [or]
6874 (13) a municipality with a population of less than
6975 75,000 that is located in three counties, at least one of which has
7076 a population greater than 3.3 million;
7177 (14) [(13)] a municipality with a population between
7278 14,000 and 17,000 that:
7379 (A) contains three or more numbered United States
7480 highways; and
7581 (B) is located in a county that is adjacent to a
7682 county with a population of more than 200,000; or
7783 (15) [(13)] a municipality with a population of less
7884 than 50,000 that is located in:
7985 (A) a county that generated $20 million or more
8086 in tax revenue collected under Chapters 201 and 202, Tax Code, from
8187 oil and gas production during the preceding state fiscal year; or
8288 (B) a county that is adjacent to two or more
8389 counties described by Paragraph (A).
8490 SECTION 2. To the extent of any conflict, this Act prevails
8591 over another Act of the 87th Legislature, Regular Session, 2021,
8692 relating to nonsubstantive additions to and corrections in enacted
8793 codes.
8894 SECTION 3. This Act takes effect September 1, 2021.
