| 7 | 7 | | relating to the regulation as a public insurance adjuster of |

| 8 | 8 | | certain persons acting on behalf of an insured for a real or |
|---|
| 9 | 9 | | personal property insurance claim. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 4102, Insurance Code, is |
|---|
| 12 | 12 | | amended by adding Section 4102.0021 to read as follows: |
|---|
| 13 | 13 | | Sec. 4102.0021. EXEMPTIONS FOR CERTAIN CONTRACTOR SERVICES |
|---|
| 14 | 14 | | OR COMMUNICATIONS. This chapter does not apply to the following |
|---|
| 15 | 15 | | actions by a contractor who has been engaged by an insured to |
|---|
| 16 | 16 | | complete work covered under a property insurance policy: |
|---|
| 17 | 17 | | (1) providing supplement estimates to the insurer; |
|---|
| 18 | 18 | | (2) submitting photographs, code documentation, |
|---|
| 19 | 19 | | manufacturer specifications, or any other supporting documents to |
|---|
| 20 | 20 | | the insurer; |
|---|
| 21 | 21 | | (3) suggesting the insured invoke the appraisal clause |
|---|
| 22 | 22 | | in the insured's policy or suggesting the insured hire a public |
|---|
| 23 | 23 | | insurance adjuster or attorney in connection with the insured's |
|---|
| 24 | 24 | | claim; or |
|---|
| 25 | 25 | | (4) engaging in conversations with an insurer, or |
|---|
| 26 | 26 | | their agent, to clarify the scope of work provided in the written |
|---|
| 27 | 27 | | estimate. |
|---|
| 28 | 28 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 29 | 29 | | a contract entered into on or after the effective date of this Act. |
|---|
| 30 | 30 | | A contract entered into before the effective date of this Act is |
|---|
| 31 | 31 | | governed by the law in effect immediately before the effective date |
|---|
| 32 | 32 | | of this Act, and that law is continued in effect for that purpose. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2021. |
