55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation as a public insurance adjuster of
88 certain persons acting on behalf of an insured for a real or
99 personal property insurance claim.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 4102, Insurance Code, is
1212 amended by adding Section 4102.0021 to read as follows:
1313 Sec. 4102.0021. EXEMPTIONS FOR CERTAIN CONTRACTOR SERVICES
1414 OR COMMUNICATIONS. This chapter does not apply to the following
1515 actions by a contractor who has been engaged by an insured to
1616 complete work covered under a property insurance policy:
1717 (1) providing supplement estimates to the insurer;
1818 (2) submitting photographs, code documentation,
1919 manufacturer specifications, or any other supporting documents to
2020 the insurer;
2121 (3) suggesting the insured invoke the appraisal clause
2222 in the insured's policy or suggesting the insured hire a public
2323 insurance adjuster or attorney in connection with the insured's
2424 claim; or
2525 (4) engaging in conversations with an insurer, or
2626 their agent, to clarify the scope of work provided in the written
2727 estimate.
2828 SECTION 2. The changes in law made by this Act apply only to
2929 a contract entered into on or after the effective date of this Act.
3030 A contract entered into before the effective date of this Act is
3131 governed by the law in effect immediately before the effective date
3232 of this Act, and that law is continued in effect for that purpose.
3333 SECTION 3. This Act takes effect September 1, 2021.
