66 AN ACT
77 relating to businesses' civil liability for COVID-19 exposure.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1010 amended by adding Chapter 100C to read as follows:
1111 CHAPTER 100C. COVID-19 EXPOSURE LIABILITY FOR BUSINESSES
1212 Sec. 100C.001. LIABILITY LIMITED. A business entity or
1313 person who owns a business entity may not be held liable for injury
1414 or death caused by exposure to the 2019 novel coronavirus disease
1515 that occurred due to the entity's activities or operations, unless
1616 a claimant proves that the exposure was caused by gross negligence
1717 or wilful misconduct.
1818 SECTION 2. Chapter 100C, Civil Practice and Remedies Code,
1919 as added by this Act, applies to a cause of action that accrued
2020 before, on, or after the effective date of this Act.
2121 SECTION 3. This Act takes effect September 1, 2021.
