8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Title 4, Civil Practice and Remedies Code, is | |
10 | 10 | amended by adding Chapter 100C to read as follows: | |
11 | 11 | CHAPTER 100C. COVID-19 EXPOSURE LIABILITY FOR BUSINESSES | |
12 | 12 | Sec. 100C.001. LIABILITY LIMITED. A business entity or | |
13 | 13 | person who owns a business entity may not be held liable for injury | |
14 | 14 | or death caused by exposure to the 2019 novel coronavirus disease | |
15 | 15 | that occurred due to the entity's activities or operations, unless | |
16 | 16 | a claimant proves that the exposure was caused by gross negligence | |
17 | 17 | or wilful misconduct. | |
18 | 18 | SECTION 2. Chapter 100C, Civil Practice and Remedies Code, | |
19 | 19 | as added by this Act, applies to a cause of action that accrued | |
20 | 20 | before, on, or after the effective date of this Act. | |
21 | 21 | SECTION 3. This Act takes effect September 1, 2021. |
