 A BILL TO BE ENTITLED
 AN ACT
 relating to businesses' civil liability for COVID-19 exposure.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Title 4, Civil Practice and Remedies Code, is
 amended by adding Chapter 100C to read as follows:
 CHAPTER 100C. COVID-19 EXPOSURE LIABILITY FOR BUSINESSES
 Sec. 100C.001.  LIABILITY LIMITED. A business entity or
 person who owns a business entity may not be held liable for injury
 or death caused by exposure to the 2019 novel coronavirus disease
 that occurred due to the entity's activities or operations, unless
 a claimant proves that the exposure was caused by gross negligence
 or wilful misconduct.
 SECTION 2.  Chapter 100C, Civil Practice and Remedies Code,
 as added by this Act, applies to a cause of action that accrued
 before, on, or after the effective date of this Act.
 SECTION 3.  This Act takes effect September 1, 2021.
