| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Subchapter A, Chapter 232, Local Government |
|---|
| 11 | 13 | | Code, is amended by adding Section 232.0016 to read as follows: |
|---|
| 12 | 14 | | Sec. 232.0016. RECREATIONAL VEHICLE COMMUNITIES. (a) In |
|---|
| 13 | 15 | | this section: |
|---|
| 14 | 16 | | (1) "Park model recreational vehicle" means a |
|---|
| 15 | 17 | | recreational vehicle that is built and certified in accordance with |
|---|
| 16 | 18 | | the American National Standards Institute Park Model Recreational |
|---|
| 17 | 19 | | Vehicle Standard, commonly cited as "ANSI A119.5." |
|---|
| 18 | 20 | | (2) "Recreational vehicle" means a vehicle that: |
|---|
| 19 | 21 | | (A) was originally designed and manufactured |
|---|
| 20 | 22 | | primarily to provide temporary human habitation for recreational, |
|---|
| 21 | 23 | | seasonal, or transitional use; |
|---|
| 22 | 24 | | (B) is permanently built on a single chassis; and |
|---|
| 23 | 25 | | (C) is designed to be towed by a motor vehicle or |
|---|
| 24 | 26 | | is a motor vehicle. |
|---|
| 25 | 27 | | (3) "Recreational vehicle community" means a plot or |
|---|
| 26 | 28 | | tract of land that is separated into two or more spaces: |
|---|
| 27 | 29 | | (A) for which water, wastewater, and electric |
|---|
| 28 | 30 | | utility services are provided or offered for a fee; and |
|---|
| 29 | 31 | | (B) on which recreational vehicles, including |
|---|
| 30 | 32 | | park model recreational vehicles, may be located for use and |
|---|
| 31 | 33 | | occupancy as temporary residences. |
|---|
| 32 | 34 | | (b) A recreational vehicle community is not a subdivision of |
|---|
| 33 | 35 | | land for the purposes of this chapter. |
|---|
| 34 | 36 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 35 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 40 | | Act takes effect September 1, 2021. |
