8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 15 | | SECTION 1. Chapter 19, Education Code, is amended by adding |
---|
10 | 16 | | Section 19.0051 to read as follows: |
---|
11 | 17 | | Sec. 19.0051. EDUCATIONAL PROGRAMS. (a) The Windham |
---|
12 | 18 | | School District shall develop and provide an educational program |
---|
13 | 19 | | that includes the curriculum requirements for a high school diploma |
---|
14 | 20 | | under Section 28.025 or a course of instruction that prepares the |
---|
15 | 21 | | person for the high school equivalency examination to each person |
---|
16 | 22 | | confined or imprisoned in the department who is not a high school |
---|
17 | 23 | | graduate and is: |
---|
18 | 24 | | (1) younger than 18 years of age; or |
---|
19 | 25 | | (2) eligible to receive special education services |
---|
20 | 26 | | under Subchapter A, Chapter 29, and younger than 22 years of age. |
---|
21 | 27 | | (b) In developing a person's educational program under |
---|
22 | 28 | | Subsection (a), the Windham School District shall consider: |
---|
23 | 29 | | (1) the duration of the person's confinement or |
---|
24 | 30 | | imprisonment; |
---|
25 | 31 | | (2) the person's current level of education; |
---|
26 | 32 | | (3) the person's educational goals and preference; and |
---|
27 | 33 | | (4) if applicable, recommendations of the person's |
---|
28 | 34 | | admission, review, and dismissal committee. |
---|
29 | 35 | | (c) The board may adopt rules as necessary to implement this |
---|
30 | 36 | | section. |
---|
31 | 37 | | SECTION 2. This Act takes effect September 1, 2021. |
