| 5 | 11 | | relating to the issuance of digital tags for the taking of certain |
|---|
| 6 | 12 | | animals. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Chapter 42, Parks and Wildlife Code, is amended |
|---|
| 9 | 15 | | by adding Section 42.0101 to read as follows: |
|---|
| 10 | 16 | | Sec. 42.0101. DIGITAL TAGS; RULES. (a) The commission by |
|---|
| 11 | 17 | | rule may develop and implement a program for the issuance of digital |
|---|
| 12 | 18 | | tags for animals, including birds, to holders of hunting licenses |
|---|
| 13 | 19 | | authorizing the taking of those animals. |
|---|
| 14 | 20 | | (b) A program developed under this section may include: |
|---|
| 15 | 21 | | (1) providing for the issuance of digital tags to the |
|---|
| 16 | 22 | | holder of a hunting license; |
|---|
| 17 | 23 | | (2) allowing a person using a digital tag to create a |
|---|
| 18 | 24 | | digital record at the time of the taking of an animal that includes |
|---|
| 19 | 25 | | information required by the department; |
|---|
| 20 | 26 | | (3) requiring a person using a digital tag to create |
|---|
| 21 | 27 | | the digital record described by Subdivision (2) as soon as possible |
|---|
| 22 | 28 | | after the taking of the animal; and |
|---|
| 23 | 29 | | (4) requiring a person using a digital tag to retain in |
|---|
| 24 | 30 | | the person's possession documentation of the digital record |
|---|
| 25 | 31 | | described by Subdivision (2) at all times before the carcass is |
|---|
| 26 | 32 | | finally processed. |
|---|
| 27 | 33 | | (c) Unless the context requires otherwise, a reference |
|---|
| 28 | 34 | | under this code to a tag includes a digital tag issued under a |
|---|
| 29 | 35 | | program developed under this section. |
|---|
| 30 | 36 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 40 | | Act takes effect September 1, 2021. |
